section of the penal Code or Statute up on which the indictment is founded. Ei ther course, would render patent the ob ject of the indictment and prosecution in this case though the offence is laid in the indictment in a technical phraseology, Which might satisfy the requisitions oi the Penal Code as contained in the de finition and description of perjury, yet, there is not that direct reference to it, by either of the courses before suggested, a: sufficiently designates the intention of the Attorney General, to prosecute for a .Pe nal Code or Statutory perjury. lam therefore, or may be required to consider the offence as perjury charged at com mon law punishable by fine and imprison ment and perpetual disability to bear tes timony—and if perjury at common law it is no felony, and consequently the or der of he Court is necessary for a Copy of the record.—The question then would be whether the variant and increased and infamous punishment, inflicted by the Penal Code of Georgia has not abro gated the common law prosecution and common law punishment? Can they be co-existent upon these doctrines applica ble in the interpretation of a Statute, which establishes a system of criminal jurisprudence as the supreme law of the State, variant from the common law in its principles and its punishments? If thuy cannot co-exist, then can an indict ment and an acquittal thereon, at Com mon Law, be the foundation in this Court, of the action of Mai: Prosecu tion.— Upon the whole then it would seem as established law, that in every case of felony the order of the Court for the copy, of the record is necessary—that according to my opinion perjury is felony under the Penal Code of Georgia,—and that the common law punishment being I thereby abrogated, an Indictment for the I offence at common law being inhibited, — I ao action for Mai: Pros : can be legiti- I jaitely sustained on an indictment at com- I aon law, prosecuted in this jurisdiction, I —and upon which there has been an ac- I qiiiltal—Juacunque via data, the plain- I tiff must fail in his action. August 8. t. Information Wanted. IN the monthofFeb’ry 1820, Emanuel Lloid left the Planters' Hotel in this City, for the purpose of going to the house of Mr. Wm. M‘Gar to obtain his working tool*: he had with him at the time about S7OO. The late Mr. Lind sey Coleman said that from the descrip tion of the above person, he believed ’ that he went to the state of Alabama with Gen. Scott: since which period he i has not been heard of. He is a tall mao, about 6 feet 1 inch high, dark complex ion, 33 year* of age, by trade a house carpenter. Any information respecting him will be thankfully received, by his brother, the subscriber.
