this my proclamation, in order to make
' known the outlines of the aforc-rccired aft,
which arc is after mentioned, to wit :
The territc. • to which the Indian title

to be laid off in the following manner ;
The lire dividing the counties of Baldwin
and Wilkin,fon is to be extended fouth for

which lies above said line, is to be attached
to, and considered as a part cf the county
of Baldwin; and that part below said line,

ty, is to be attached to, and confldercd as a
pirt of the county cf Wiikinfon. ’The
whole territory nfiirtihid is to he divided in
to thirty-eight didrifts, as nearly equal in
size r.s they can he conveniently made, by
rmrling parallel lines fouth forty-five degrees
weft, and others interfering them at right
angle; ; the land contained in the several
didrifts, except the reserve aferefaid, is to *
he divided by lines running parallel with
the lints dividing said diftrifts, and others
rroffiVig them at right angles, Co as to form
traft - , (forty-fi-e chains fquart) to contain
two hundred two and an half acres each.
,The fraftional parts cf surveys which may
be occafiancd in each diftrift, by the natural
or artificial boundaries off. id territory? are
to be set apart for the redemption of the
public debt, under the direftion cf a future
Legifla-urf.
The Surveyors appointed to make the sur
veys in the several diftrifts as aforefaid, are
to give bond for the faithful difeharge of the

cireft, in the penalty of ten thousand dollars
• each, psvahle to the Governor for the lime
being, or ids fucotiTors in office, with such
fecuritv as may be approved of by him, or
a majority of the Just ices of the Inferior

said Surveyors may re fid a ; which bonds are
to bo taken by the Governor, or thcalore
faid Jufttcvs, and deposited in the Executive

The forveyors aforefaid are to make the
surveys cf their refpeftive diftrifts in their
“ own proper per fon”—they arc immedi
ately rfrer the boundary and diftrift lines
shall have been run by the proper authority,
to mark or cauls to I mulct'd, plainly and
difiinftly upon tree*, if pr.fticablc, othcr

may be required to run in making the iur

I he surveys containing two bundled two
and an h.df acres, as aferefaid, arc to be
dillributid by a lottery, m which puffins
are to be entitled to draws as after mention
ed, to wit :—Every free male w Kite perlite,
twenty-one years ot age and upwards, who
is a citizen ot the United States, and has
resided in this ftatc three years immediately
preceding thepaflage of the aft afore.recited,
and paid a tax tew aids the fnpport of go.

i on lawful bufincfs) onedraw—every free male
person of like defeription, having a wife,
or legitimate child or children under the
age of twenty.one years, two draws—all
widows with like refidcnce, one draw.-.all
free female white persons, who have arrived
to the age of twenty.one years or upwards,
and have resided in this Hate, as is above,
and are unmarried, one draw—all families
of orphans residence as aforefaid, under the
age of twenty-one years, whefe father is
dead, one draw—and all families of orphans
confiding of more than ere, who have nci
their father or mother living, two draws—
but if only one, then such orphan is to
have one draw ; thedraws cf orphans to be
entered in the county and difttift where the
elded of each family of them refidcs.
No person who drew a prize or prizes In
the late land lottery, is to be entitled to any
draw or draws in theontnow contemplated*.
Alphabetical lids of persons entitled to
draws in the lottery aforefaid, are to be
made out within three months from the psf.

sons, not exceeding two to each battalion
ciftricl, as the JuUices of the Inferior Court
in each county may appoint; and it is de
chred to be the duty of the said Jaftices to
tn;d;e such appointments. The persons, so
appointed are f» attend in each Captain's
difhift, on Upriany feveraf day s the said

(having lirft given ten da) s notice in each
didrift of such attendance) for the purjkfe
of taking down the names of persons entitled
to draws as aforefaid, and are to receive,
as a com pen fa t ion for their fcrvices, from
the applicants f?r draws, twelve and an
half cents for each draw by them entered ;
and previous to entering on the duties of
their appointments, they are to take the
following oath, which l« to be adminif,
tesed by any of the said Jultices :—“ I, ‘
, do solemnly swear or affirm, (as
the case may be) that I will not receive,or
register any name except the person giving

aft." 'l'he Hits aforefaid, when completed,
and conies #f them depoftied in the office of
the refpeftive clerks cf the Superior Court,
* are to <vi transmitted to the Executive Office,
by the persons appointed to make them cut.
All applicants for draws h the said
lottery, except widows, are to take the
following oath, which is to be administered
by the persons appointed to take down their
names as aforefaid, to wit: “I ,
do foiemnly swear or affirm, (as the case
may be) that I am a citizen cf the United
States, and have resided in this ftatc three
years immediately preceding the passing of
this aft, and am now an inhabitant of this
diltrift ; that I am twenty-one y#*ars cf
age ; that I have a wife, child or children
/as the case mar be) that 1 have not given
tn my name for any draw or draws in the
prefect contemplated lottery, in any other
part of ibis Hare ; that I have not drawn
a frsft of land in the former lottery j and
that the orphan or family of orphans whom
I now return, is or are entitled to a draw
or draws under this aft, to the left cf try
knowledge... So help me God." And wid
ows, applicants as aforefaid, the following
oath :—“ J, , do folesdy swear or
afirm, (as the case may k) that 1 cm a
widow ; that 1 have resided (he three lad
years in this Hate, and am now resident in
this duhift ; that I have nor cut in my
name for a draw in the prelent lottery in any
other part nf this state ; and that 1 have not
drawn land in the former lottery, to the
heft cf my knowledge and belief—So help
me God."
The Governor is to cause tickets to be
prepared and the lottery drawn in the fol
lowing manner :—The. names of persons
entitled to dratvs, are to be written on (e
-partite pieces of paper, as nearly equal in iirc
as they can be made, and depolited in a bex
or wheel, conftrufted for the purpose ; and
the blanks and prizes are to be deposited in
another box or wheel; and from each wheel
one ticket at a time is to be taken and de.

Superintend the drawing of the lottery, who
are to declare the refuh, and raufeeach name
agairft which a prize may be drawn, and a '
ddcription of the prize, to be entered in a
book to be provided for thst purpose.
One month’s notice of the day the draw,
ingof the lottery will commence is to be
given in the fevettd Gazettes before men.

die, the Governor is authorized to fill the
vacancy thereby occasioned. And if any
Surveyor shall fail to execute the trust repo
sed in him, either from inattention cr odte.

The Diftrift Surveyors are to take an
oath faithfully to difeharge the duties rrqui.

pointed out to’ them by the Surveyors as

fame which oath is to be administered by
the Diftrift Surveyors.
No lurveya or grants for land in the a.
forefaid territory are to be admitted to a
jury as evidence of t»ie to the lands therein,
except thole obtained by virtue and under
the authority of the afore.ieceited aft.
Persons against whofc names lots cf land
may be drawn, are to receive grants for the
fsme, on paying into the Treafuxy of this 1

flats, fix dollars per-hundred acres; tut If
any person entitled to any let of land as a
forefaid, (hall fail to pay that sum and take
out a grant for the fame, within twelve
months from the day thfcdrawing cf the lot
tery i? completed, then fuel) Jot (hall revert
to, and be veiled in the Hate, and appro
priated for the redemption of the public debt.
Returns of petfons entitled to draws as a
forefaid, made -contrary to the true intent
and meaning of the alore-rcceited aft, are
declared to be fraudulent; and all grants
which, may he iffueti in conference of
draws made in the contemplated lottery, cn
any fraudulent return, are declared to be
null and void, and the land so granted is to
revert to, ahd become the prt perty of the
Bate.
Now therefore, the Juflices of the Infeii
or Courts cf the refpeftive counties—the
pcrfpns to be appointed to make out the al
phabetical lifts afortfaid—and all perfens
entitled to draws in the contemplated lottery
under the afore-recited aft, are called upon
and required to comply with the requifu
tions thereof.

a Negro fellow and a wenth at the heufe cf
Mrs. M'Corcle at Guriy’s bridge, Lincoln
county Mrs. M'Ccrcle it appears, had
interfered, and the fellow who belonged
to her husband, went, cut a club, and on
bis return, knocked her down, and mur
dered her on the spot.-.-the villain made
his cfccpc. A reward is offered, and the
fellow is deferihed as being 5 feet 9 inches
high, about 30 years of age, and having on
a blue Jacket--his name is Barrett.
