In Iho Government of thn United States Congress alone has that power. Rare instances have occurred io the United States where the writ was suspended by order of a military commander, in oases of axtreme necessity, fur a limited time; but they were not claimed aa an exonse based upon a tempo rary aad axtreme neoeeaity. The suspeocion of the writ by any ether authority than Con gress, the Courts and Judges are not const it u* tionallj bound to respect. If there is any al legation or supposed allegation uf crime against an individual, be unit be prooeeded against by a legal warrant, issued by comt petent authority aider oath; and bole en titled to on examination before commitment ; and if arretted without warrant he must be delivered over for such examination. The firmness of judges and the honesty of jurors are the sore nope and protection or ev ery citiseo. Upon this rock all persona intrus ted with the sdministiatioo of the laws mu»t stand, holding the scales of justice with a stea dy hand, unmoved by the rude blasts of f«o- lion or the popular surges of pony. Ths Fed eral Judges are sworn, “That they will ad minister justice without respeci to persons, and de equal right to the poor aod to the rich, snd that they will faithfully aad impartially diaobarge and perform all the duties incum bent on them as judges, acoording to the beat of their abilities and understanding, agreea ble to tho Cooatitution and laws of the Doi ted States.” There is no higher law binding upon the oitixen ihao the Constitution and law a of hia oeuntry.
