each diftrid it (hall be lawful for the collec
tor to grant a permit to unlade at any port or
place withiu the diftrid, arid to appoint or
put o*i board any (hip or veflel for which a
permit is grafted, one or more searchers or
iufpedors, as may be necefiary for the secu
rity of the revenue;
Arid be it further etuißed, That every port
of entry eftablilhed by this ad, lhall be a port
of delivery alto r Proviaed always, That
no fliip or veflel not wholly belonging to a
citizen or citizens of the United States, lhall
be admitted to unload'as any port or place ex
cept the following, to wit: Portsmouth, in
the state of New-Hampfllire; Portland,
Falmouth, Dighton, Salem, G’loucefter, NeW
btvry-Port, Marblehead, Sherbourne, Boston,
Plymouth, Wifcaflet, MactriaS and Penob
fcot, in the state of Mallachufekts; New-
London or New-Haven, in the state of Con
necticut; New-York; Perth-Amboy or Bur
lington,- in the state of New-jerley; Philas
delphia; Wilmington, Newcastle and Por't-
Penn, irfthe state of Delaware; Baltimore;
Vienna, Oxford, George-Towfl
on Potowtnack, Chester Town, Town Creek,
Nottingham, Nanjemoy, Diggs’s Landing,
Snow-Hiir and Catrolfburgh,. in the state of
Maryland; Alexandria, KinfaJe,. Newport,
Tappahannock; Port-Royal, Frederieklburg,
Urbanna, York-Town, Weft-Point, Hamp
ton, Bermuda Hundred, City-Point, Rocket’s
Landing, Norfolk or Portsmouth, in the state
of Virginia; Cbarisfton; Gcorge-Town or
Beaufoft, in the state of South-Carolina; or
in either of the diftrids of Savannah, Sun
bury, Brunswick or St. Mary’s, in the state
of Georgia; nor shall any ftirp or veflel ar
riving from the Cape of Good Hope, or from
any place beyond the fame, be admitted- to
enter at any other than the following ports,
to wit: Portsmouth, in the state of'New-
Hampshire; Boston, Newbury-Port, 4 Salem,
Glouccfler, Portland or Falmouth, in the state
of Massachusetts; New-London or New-
Haven, in the state of Connedicut; New-
York; Perth Amboy; Philadelphia; Wilm
ington in the state of Delaware; Baltimore
town, Annapolis or George Town, in the state
of Maryland; Alexandria, Norfolk or Ports
mouth, in the state of Virginia; Charleston,
George-Town or Beaufort, in the state of
South-Carolina ; Sunbury or Savannah in the
state of Georgia : Provided, That nothing
herein contained ftrall be construed to prevent
the master or commander of any lliip or vef
jfel, from making entry with the coliedor of
any port or diftrid in which such (hip or vef
i'el may be owned, or from whence (lie may
have failed on such a voyage.
And be it further enailtd , That the master
or commander of every (hip or vcftel bound -
to a port of delivery only, in any of the fol
lowing diftrids, to v/it: Portland aod Fal
mouth, Bath, Newbury-Port, New-London,
(except the port of Stonington in the said di
ftrid) Norfolk and Portsmouth, Bermuda*
Hundred and City-Point, York-Town or
Tappahannock (except the port of Urbanni
in the said diftrid) (hill firft come to at thy
port of entry of such diftrid, with his (hip
or veflel, and there make entry, deliver a
manifeft of her cargo, and pay, or secure to
be paid, all legal duties, tonnage, port-fees
and charges, in “manner by this ad provided,
before such fliip or veiTel lhall proceed to her
port of delivery ; and that any fliip or veflel
bound to a port of delivery in any other di
ftrid not -under like reflridrons by this ad,
or 'to either of the ports of Stonington or
Urbanna, may firft proceed to her port of
delivery, and then make legal entry within
the time by this ad limited.
And be it further enaded, That the master
or commander of every fliip or veflet, if
bound to the diftrid of Nottingham, (hall,
before he pafles by the port of Town-creek,
and immediately after his arrival, deposit
with the furveyOr of the said port, a true
manifeft of the cargo on board such (hip or
veflel; if bound to any diftrid on the Potow
mack, (hall, before he pafles by the rivers
St, Mary’s and Yeocomico, and immediately
after his arrival, depoflt with the surveyor at
St. Mary’s, or the colledor at Yeocomico,
as may be moll convenient, a true manifeft

to be made, without which certificate no such
entry lhall be received.
And be it further enaßed, That the duties
of the refpedive officers to be appointed by
virtue of this ad, lhall be as follows: At
such of the ports to which there lhall be ap
pointed a collector, naval-officer and survey
or, it lhall be the duty of the coliedor to re
ceive all reports, manifelts and documents
. made or exhibited to him by the master or
. commander of any Ihip or veflel, conform
ably to the regulations prefenbed by this ad,
to make due entry and record in books to be
kept for that purpose, all such manifefts and
the packages, marki and numbers cont’ahied
thet ein; to receive the entry of all ihips and
veflels, aud of all the goods, wares and mer
chandize imported in such Ihips or veflels,
together with the original invoices thereof;
to eftiinate the duties payable thereon, arid to
eudoiie the lame bn each entry; to receive
all monies paid for duties, and to take all
bonds for the' payment' of duties;
to grant all permits for the unladihg and deli- '
very of goods; to employ proper persons as
weighers, gaugers, and infpedors,
at the several potrs within his diftrid, toge
ther with such persons as lhall be necellary
to serve in the boats which may be provided
for iecuriug the collediun of the revenue ; to
provide at the public expence, arid with the
appt Nation of the principal officer of the
treasury department, store-houses forthefafe
keeping of goods, together with such feales,
' weights and measures, as lhall be deemed ne
cessary, and to perform all other duties which
t lhall be afligned to him by law. It Hull he
the duty of the naval-officer to receive copies
of all manifefts. to eftiinate and record the
duties on each entry made with the coliedor,
and to corred any error made therein, be
fore a permit to unlade or deliver lhall be
granted ; to counterfigtr all permits and clear
i ances granted by the coliedor. It lhall be
the duty of the surveyor to superintend and
dired all infpedors, weighers, tneafurers and
guagers within his diftrid, and the employ
ment of the boats which may be provided for
securing thri colledion of the revenue ; to go
on board Ihips or veflels arriving within his
■ diftrid, or to put on board one or more in
-1 fpeclots, to afeertain, by an hydrometer,

rating all diftiiled spirits which Hull be of the
proof of twenty four degrees as of Jamaica
proof, and to examine whether the goods
imported are conformable to the entries there
of ; and the said surveyor ftiall in all cases be
fubieft to the controul of the coliedor and
naval-officer.
And be it further enabled, That every col
iedor appointed in, virtue of this ad, in case
of his neceflary absence, sickness, or inability
to execute the duties of his office, may ap
point a deputy, duly authorifed under hw
hand and seal, to execute ai’.H perform'on his
behalf, all and Ihiguiar the powers, fundions
‘ and duties of coliedor of the diftrid to which
he the said principal is attached, who lhall be
answerable for the negled of duty, or other
mal-conHud of his deputy ia the execution
of the oflice.
And be it fur thee enabled, That in case of
the difabiluy or death of any coliedor, the
duties and authorities veiled in him by this
aft lhall devolve ou Ims deputy, if any such
hath been appointed, (for whole condud the
estate of such difablcd or deteaf:d coliedor
ftiall be liable) aud the said deputy ihaii cx
crcile the authority aud perform all the duties
until a fucceflor lhall be appointed. But in
cases where no deputy is appointed, the au
thorities and duties of the disabled or deceas
ed coliedor, ihaii devolve upon the naval
officer of the fame diflrid, until a fucceflor,
duly authorifed aud fwom, flit!) enter upon
the execution-of the duties of the fsid oftite.

And bt it fur tl't tnaQed, That at such of
the ports eltabliihcd by this aft, to which a
collector aod/urveyor only are assigned, the
laid collector lhall execute ail the duties here
in required to be done by the colleftor and
uaval-officer at otber ports. That at foftf

be his duty to receive and record the copies
of all mtrnifefls transmitted to him by the
colleftor ; to enter apd record air permits

> gauge, wetght, mealure and quality of the
goods fpecitied therein ; to take care that no ’
goods be unladen or delivered from anv flnp
or veflel without such permit ; and to perform
all other duties requited to be Hone by a sur
veyor. f hat at luch ports of delivery only,
to which no surveyor is assigned, it lhall be
the duty of the colleftor of the diflrift to at
tend the utflading and delivery of goods, or
in calcs ot ncceffity, to employ a proper per
son or for that purpose, who lhall pos
sess the - power, and be entitled to the like
competition allowed to infpeftors during
the time they are employe! Jivery colleftor,
naval-officer and surveyor, lhall attend iu
person at the port or diftfift for which he is
appointed, and before he enters on the execu
tion of his office, shall take an oatji or affirm
ation in the fotm following, to wit: “ I

V«‘ the'* case may be) that I will truly and
“ faithfully execute and perform all the dtt

animation lhall be administered by any jttf
tiCe of* the peace, and a‘certificate thereof,
under the hand and seal of such julfice, trans
mitted within three months thereafter to the
comptroller of the treasury : Auy colleftor,
naval-officer or surveyor, failing herein, lhall
forfeit and pay tw6 hundred dollars, recover
able with costs in any court having cognizance
thereof, to the use of the informer. And no
weigher,* gauger,- tneifuref, or infpeftor,
fliali execute the duties of his office, until he '
lhall have'taken the above oath or affirma
tion. '
rind be it further enabled, That the collec-'
tors, natal-officers and fttrveyors, to be ap
pointed by virtue of this aft, lhall refpeftive
iy k<fcep fair and true accounts of all their
tranladions relative to their duty as officers
of the cuftotUs, in such manner and form as
may be directed by the proper department,
or officer appointed by law to fupenntend the
revenue of the - United States; and lhall at
all times lubinit their books, papers and ac
counts, to the infpeftion of such perlons as
may be appointed for that purpose : And the
coiicftors of the different ports, (hall at all
times pay to the order of the officer who shall .

three months, or oftner if they shall be re

ter or other person, having or taking the
charge or command of any flop or-veflel,
bound to any port of the United States, from’
apy foreign port or. place, lhall deliver upon *"
demand, to any officer or other person law
fully atithcrifed, who shall firft come on board
his ship or veil el, two manifefls, signed by
the fatd mafler or person hiving command, -
and fpecifying in words (and not in figuret)
a true account of the loading which such ship
or veflel had on board at the port from which
lhe iaft failed, and at the\ime of her failing,
or at any time since, the packages, marks and’
numbers, and noting thereon to what port in
the United btates such ship or veflel is bound,
and the name or names of the petfon or per
fous to whom the‘goods are configucd, or in *
calcs where the goods are (hipped to order,
the names of the ihippers, noting the good*
coijfigned to their order; one of which tnani
