At Fi r st Session, begun arul held at the City of Washington, in the Ter ritory of Columbia, on Monday the seventh of December, one thousand eight hundred and one, AN ACT tfl amend an aft to eftahl'Jh the compensations of the officers employ ed m the collection of the duties on im ports and tonnage ; and for other pur. poses,” BE it enafted by the Senate and Honfe of Reprefeulativcs of the United States of America, in Congrcfs nffernbled, That from and after the thirtieth day of June, in the present year, there- shall be paid, annually, to the collector of the cuftomS ’ for the diftrift of Richmond, in addition to the fees and emoluments other wise allowed by law, the film of two hun dred and fifty dollars. See. 2. And be it further enafted, That from and after the fa Id thirtieth day of June, the salary heretofore allow ed by law to the collector of the customs for the diftrift of Percrfhurg be, and the feme hereby is difeontinued. Sec. 3. And be it further enafted , That from and after the laid thirtieth day of Jane, whenever the annual emolu ments of any colleflor of the customs, af ter deducting therefrom the expenditures incident to his office, shall amount to more than five thousand dollars; or those of a naval officer, after like deduction, to more than, three thousand five hundred dollars, or those of a surveyor, after a like (ieduflion to more than three thousand dollars, the furplas shall be accounted for, and be paid by them, refpeftively, to the Treafyry of the United States : Provided always, that nothing in this contained shall be conftraed to extend to fines, forfeitures and penalties under the revenue laws of the United States. BE it enabled by the Senate and House of Rep refentatives •of the United States of America, in Congre/s assembled , That the inhabitants of the Ealtem divi sion of the territory north well of the river Ohio, be, and they are hereby au thorized to form for themfelvc? a conlli tution and state government, and to as sume such name as they (hall deem pro per, and the said state, when formed, (hall he admitted into the union, upon the fame footing with the original states, in all refpefts whatever. Sec. 2. And he it further enabled, That the said (rate shall conlift of all the territory included within the following ( boundaries, to wit : bounded on the call by tlte^cnnfylva ni a line, on the louth by the Ohio river, to the mouth of the great Miami river, on the weft by the line drawn due north from the mouth of the great Miami, aforefaid, and on the north by an east and weft line, drawn through the southerly extreme of Lake Michigan, running cast after interfering the due north line aforefaid, from the mouth of the great Miami, until it (hail interied! Lake Erie, or the territorial lined- and thence with the fame t'hrough * O 1 Lake Erie to the Pennsylvania line, a forefaiu ; Provided, that congrcfs (hall be at liberty at any time hereafter, either to attach all ihc territory lying east of the line to be drawn due north from the mouth of the Miami, aforefaid, to the .territorial iiac, and north of an east and weft line drawn through the southerly extreme of Lake Michigan, running east as aforefaid to Lake Erie, to the afore faid state, or dispose of it othenvife, in conformity to the fifth article of compart between the original states, and the peo ple and states to be formed in the territo ry non h weft of the river Ohio-g See. 3. And be it further enailed. That all that part of the territory of the United States, north weft of the river Ohio, heretofore included in the eastern division of said territory, and not includ ed within the boundary herein preferihed for the said state, is hereby attached to, and made a part of the Indiana territory, from and after the formation of the fail ftnre, fubjeft nevenhelcfs to be hereafter difpoled of by Congrcfs according to the right refereed in the fifth article of the . ordinance aforefaid, and the inhabitants therein (hall be entitled to the fame pri vileges and immunities, and fuhjert to the lame rules and regulations, in all re fperts whatever, with all other citizens rcliding within the Indiana territory. Sec. 4. And be it further enailed, That all male citizens of the Unircd States, who (hall have arrived at full age, and redded within the territory at lead one year previous to the day of elertion, and ihaii have paid a territorial or coun ty tax, and all persons having in other refperts, the legal qualifications to vote for reprefematives in the general aflembly of the territory, be and they are hereby authorifed to choose repfeienta lives to form a convention, who fit all be appor* tioned amongst Ac several counties with* in the eastern division aforefaid, in a ra* tie, of one representative to every twelve hundred inhabitants of each county, ac cording to the enumeration taken under the authority of the United Statei, as near as may be that is to fay, from the county of Trumbull, two representatives; from the county of Jcfrerfon, seven repre sentatives, two of the seven to be elected within w'hat is now known by the coun ty of Belmont, taken from Jcfferfon and Walhington counties ; from the county of Walhington, four representatives; from, the county of Ross, seven reprefentative*, two of the seven to be eleded in what is now known by Fairfield county, taken from Ross and Washington counties ; from the county of Adams, three representa tives ; from the county of Hamilton, twelve representatives, two of the twelve, to he clewed in what is now known by Clermont county, taken entirely from Hamilton county ; and the eleftion tor the representatives aforefaid, {hall take place on the second Tuefday of Oftobcr next, the time fixed by a law of the ter ritory, entitled‘An Aid to afeertain the number of free male inhabitants of the age of twenty one, in the territory cf the United States north-welt of the river Ohio, and the elections of re prefentativjwr die ? fame/ for electing representatives ,\o th# general assembly, and Ural! be'ntld atid conducted in the fame manner as is provided by the afore faid aft,/except % that%he qualifications of elector# shall be asJieAi fpecified. Sec. 5. Andje V \furthcr enacted, I That the members convention, thus duly elected, be, apd they are here by authorifed to meet at Chilicoche, on the fir it Monday in November next; which convention, when met, (hall firlt determine by a majority of the whole num ber elected, whether it be or be not ex- at that time to form a constituti on and (late government for the people, , within the said territory, and if it be de termined to be expedient, the convention (hall be, and hereby are authorifed to form a constitution and state government, of if it be deemed more expedient, the said convention shall provide by ordinance for electing representatives to forma conftltu tion or frame of government; which said representatives shall be chofon in fiich manner, and in fitch proportion, and shall meet at such time and place, as (hall be preferibed by the said ordinance; and shall form for the people of the said (late, a constitution and date government; pro vided the fame shall be republican, and not repugnant to the ordinance of the thirteenth of July, one thousand seven hundred and cighty-feven, between the original states and the people and states of the territory north-welt of the river Ohio- • Sec. 6. And be it further enabled, That until the next general census shall he taken, the said state lhall be entitled to one reprefen cative in the house ot repre sentatives of the United States. See. 7. And be tt further cnaAed , That the following propositions be, and the fame are hereby offered to the con. vention of the eastern state of the said territory when formed, for their free ac. ceptancc or rejection, which, if accept ed by the convention, (hall be obligatory upon the United States. Ftrfi, That the feddion number fivteen in every township, and where such ficti on has been fold, granted or disposed of, other lands- equivalent thereto, and molt contiguous to the fame, shall be granted to the inhabitants of such township, for the use of schools. 'Second. That one twentieth part of tho nett proceeds of the lands lying within the laid fiatc fold by Congress, from and after the thirtieth day of June next, af ter deducing all expcnces incident to the fame, lhall be applied to the laying out and making public roads, leading from the navigable waters emptying into the Atlantic, to the Ohio, to the said date and through the fame, such roads to be laid out under the authority of Cong refs, with the confcnt of the fevcral dates through which the roads (hall pals : Pro~ nj'ided always, That the three foregoing pronofitions herein offered, are on the conditions that the convention of the said date drill provide, by an ordinance irrevocable, without the consent of the - United States, that every and each tract ot land fold by Congress, from and after the thirtieth day of June next, lhall be, and remain exempt from any tax laid by order, or under authority of the date, whether for date, county, townlhip or any other purpose whatever, for the term of five years from and after the day of sale.
