The plaintiff was nonsuited, and a dis pute arose about the costs. Gamble for the defendant,contended that the plaintiff was liable to pay the defendant’s witness es. Walker, for the plaintiff, objected, and contended that as there had been no trial, and the witnesses were not sworn, the plaintiff was not liable to pay their fees, &c. and cited and relied on the de cision of this Court, “ that where witness es aro not sworn on the trial the party who summoned them must pay them. By the Court.—The plaintiff upon a nonsuit or verdict against him is liable to the defendant for all costs by him expend ed, (23 Hen. 8 Ch. 15 Sch, Dig. 160,) and the fees of witnesses are a part of the costs of a suit, and may be taxed in the bill of costs. (Prin. Dig. 211.) If the doctrine contended for by the plaintiff’s counsel were true, a rich plaintiff might ruin a poor defendant, by bringing repeated actions, and causing the defend ant to summon his witnesses, and then suffering repeated nonsuits, taking care not to summon anv witnesses himself.— The decision of this Court, which has been cited, and which was made for the first time by the late Judge Walker, is correct; and the reason is this : li a par ty do not swear a witness whom he has summoned, it is to be presumed that lie knows nothing, or is n.ol material, or Would testify against the party who sum moned him, iu either of which events it would be wrong to make the opposite par ty pav Ids fees ; for if the party who is cast in suit, is obliged to pay all the wit nesses who aro summoned by the oilier party, it would be unjust and oppressive. And the law isdirectly trie .other way, and in support of this decision, for by the Ju diciary of 1799, (P>in. Dig. 2\U> is ex pressly provided, that no party csst ill any suit shall be taxed for the cost ot more than two witnesses to any material point in the cause, which shall be specially cer tified by the Court. Now, how can the Court certify to what point the witness testified, unless indeed he be sworn and do testify. . „ , But the case of a nonsuit is very differ- «nt, because the plaintiff by bringing his action, compels the defendant to prepare for his defence, by summoning his witness es, and then by his own act iu suffering a nonsuit, puts it out of the power of the de fendant to have his witnesses sworn, and examined.
