When a bond is given, to make titles to land

by the Executoi or Administrator of the obligor,
but mar if the time has elapsed and the bond be
come forfeited, maintain an action of debt for the
penalty.
This was an action of debt on a bond,
conditioned to make titles to a tract of
land ; and the declaration was demurred
to on the ground that one of the*! obliuors,
i. e. E. Short being dead, if was incum
bent on the obligee or his administrators
to have applied to the court of ordinary
to cause the representatives of E. Short,
to make the titles, and that unless such
application wore made, and a refusal on
the part of the representatives stated and
proved, this action could not lie on the
bond under our law.
By the Court.—Several questions a-
rise upon this demurrer—first whether if
E. Short died before the time titles were
to he made, his representatives could
make titles, when by the terms of the
condition of the bond, they are to be made
by both the obligors ? —
2d. If ho died after the time when the
tills were to be made, whether the con
dition being broken, the penalty did not
become a debt, and take the case out of
the operation of the statutes of 1799, anti
1805.
3d. Whether in either case the obligee
is hound to take a title from the represen
tatives.
1st. It does not appear from the bond
or any of the pleadings in the cause, what
estate was held in the land by the obli-
\ gors, and therefore as the bond is joint,
I must presume that the land intended to
have been conveyed, was held by E.
Start and Barrel Richards in jniutenan-
cy, and that therefore on the death of
Short, the title survived to Richards.— If
so, then no title or interest now rests in
the executors of Short, and consequently
they cannot make title under the acts of
1799, and 1805.
2d. If Short died after the time when
"titles were to have been make, then the
bond had been forfeited for the condition
broken before his death, and the penalty
had become a debt, and the bond would
net be within these statutes of 1799, and
1805.—Prin. Dig. 158, 166.
3d. But in either case I apprehend that
the obligee is not bound to take the title,
or to apply to the ordinary after the bond
has been forfeited, because the remedy
given by those acts is cumulative, and the
obligee may pursue his remedy under
them, in a case where they will apply, or
proceed in debt for the penalty of the
bond, assigning breaches under the statute
of 8, and y, Win. 3, Ch. 11—See Sell.

The demurrer is therefore overruled.

talent at the Bar, and in society were em
inent, met his acquaintance, Jemmy Ba—
four a Barrister, tvho dealt greatly in hard
words and circumluous sentences. Per
ceiving that his ankje was tied up with a
silk handkerchief, the former asked the
cause. “ Why, my' dear sir answered
the wordy lawyer, “ I was taking a rural,
romantic rambles in my brothers grounds
when coming to a gate, I had to climg over
it, by which I came in contact with the
first bar, and have grazed the epidermis on
my skin, attended with a slight extrava
sation of blood.”—“ You may thank your
lucky stars,” replied Mr. Erskine, “ that
your brother’s gate was not as lofty as
your style, or you must have broken your
neck,”

TO ARCHITECTS.
P ROPOSALS will be received by the under
signed, till the 1st of February next, for
erecting a MASONIC HALL in this City.
The building is to be sixty feet front, by nine
ty deep, four stories high, of brick, the roof sla
ted, and the front rough cast.
The basement story, containing two stores
and a passage, to be ten feet, pitch : the second
floor, appropriated to public purposes, fourteen
feet; the third, containing a lodge room and its
appendages, fourteen feet; and the fourth, con
taining a chapter and preparation rooms, eleven
and a half feet, with an archwd ceiling, rising
four and a half feet, and three sky lights.
In front of each of the second and third stories
are to be four pillars ; the lower Doric, the up
per Ionic, of brick, rough cast, with stone piinths,
bases and capitals.
The stairs are to be winding, from the ground
floor to the top; and under the whole buih ing is
to be a cellar.
The work must be done in the best manner,
and of the best materials. Lumber can be ob
tained in this city, at ten dollars per thousand,
superficial measure ; and brick, at seven dollars
and fifty cents per thousand.
Further paiticulars will be furnished on appli
cation to the undersigned.
When the contract is made, good security will
be required for the contractors’ complying with
their proposals ; and they will be accommodated
with advances, during the progress of the work,
the funds being now in hand for the building.
