By Atlanta and Noahrillc New* Afonoy bi the Strv of yesterday morning appeared a brief reetUI of the titoatioeon the A nooga Ballroad. This matter Is one of in tor set, not only to those Immediately concerned in the road, but to railroad men and the public generally. Therefore, paaking use of our exchanges, we give to-day such ad ditional particulars aa are at hand. In the Montgomery Adtertiter of the fth, we find the proceeding* of th* United States Court in which the rood was adjudged a bankrupt. The petition of W. A.'C. Jonas, a creditor of the Ala bama and Ohattanooga Ballroad Company, to have said company adjudged a bankrupt, waa beard be fore J udge Bustoed, yesterday morning. The peti tioner alledg d in th* usual form that he is a cred itor of the company holding lie commercial paper past for about sixteeu thousand dollars, aud that the oowpauy, being a trader, had fraudulently stopped or suspended and not resumed payment of it* commercial paper within a ported of fourteeu days, according to the provisions of the Wth eeation of tin Bankrupt Act When th* case was called up Judge Kioe and Gen'l Morgan annnounoed that they ap peared for Mr. tiUnton but the Conrt ruled that Mr. Stanton waa uot a party to the proceedings and would not hear his counsel. Hon. K. W. 1‘ettus appeared at the request of the Court as Amiau Cura. The main discussion was had upon the question whether or not. the company waa a "trader" within the mean ing oi the Bankrupt Act The Court held the affirm ative, and adjudged the oompany a Bankrupt. Hon. E. H (Iraudiu and John F. Bailey, Esqrs,, were ap pointed special custodians to take temporary charge of the property of the Bankrupt, who were required to give bond in the sain of fifty thousand dollars, with sureties to be approved by the Court. We have hear! the argument of Judge, Peters highly com- mended by tho*e who heard it Hou. A. J. Walker and Colonel John A- Elmore appeared for the petitioning creditor. We learn that the tem porary custodians have already given bond In the un of fifty thousand dollars. The Chattanooga Times published at the scene of conflict has an editorial upon the subject from which the following paegraphs are extracted: Mr. titan ton states that the decision was a snap Judgin' nt. that be asked for time to show cause why the Road should not be forced into bankruptcy, but be bas refused. While in Washington he obtained the oontract for tbe through mail from New York to New Orleans his Road, and mada such business comblns- i with other Roads as to ensure a monthly busi ness of $'0,000 immediately. With this he expec ted to be able to raise money to pay off his laborers, Ac. Aa matters now stand, the affairs of tbe JRoad are In a very nr led condition. Mr.|Btanton is|determlned to fight the bankruptcy proceedings aud has sued the Hoad for $000,000, on account of money advanoed and endorsements given for the Hoad. The laborers down the road art in a starving con dition. An effort waa made on yesterday to send them a train loaded with provisions, but tbe loco motive eugiueers, who are on s strike for their wages, would not permit on* of their number to run an engine,, aud. prevented the engiue from being Ared up- The feeling among the laborers and others along tbe line of the road ia vey bitter. There Is one thing certain, and that is that if tbe road ia declared bankrupt now, Its aseets will not meet more of it* liabilities than are represented by the bonds endorsed hy Alabama, which are a prior lien upon tbe road.
