A Heavy Law Salt. A New Y'-.k dispatch of the 10th to the Western Associated Press, gives th« following: Tbs Westoru Division ot the Western Korili Carolina Haiitoad Cotnyany bring nit in the Supreme Court ugunei Huliii-y W. Hopkins it Co., to recover BtvXJ.IXW oaan accepted order, 'i'lw nut grow out of issuing four millions of bonds by too State of North Carolina to plain tills, George W. Bwepson, who was I’rosideut at the Company at the lime, and hlnton 8. LiItlOlivia, who, it is alleged, sold bonds in this city, and with somewhat over s million holism of the proeeeds bought the bonds of some of the Florida Uailioad Companies, which wore after wards consolidated and to which the Florida Legislature offered State bonds in exchange for the first mortgage bonds of the consolidated company. These Florida bonds wore sent to utis city to Hopkins & Co. for sale. The Slate of North Carolina, however, appointed a Commissioner to examine into what had been done with the bonds of the itailroad, and it is alleged that under threats of eriminsl prosecution, Hwepaon and Liuletleld gave an order for <8WU,0UU is favor of the North Carolina Hoad, and offered to furnish iron for fif ty-three miles of that road. This order Hopkins k Co. aooeptod, but afterward declined to pay, on the ground that they had not received the money for all the bonds; whereupon Sidney W. Hopkins was arrested and placed upon (KWU.UOO bail. To-day a motion was made to va cate the order of the arrest. It was argued by the defense that Swcpson and Littlcneld had no nght to pay their own private debts to the North Carolina ltosd with the proceeds of a sale of bonds issued to a Florida railroad company for a spcciiio purpose. Tbe plaintiffs argue Unit by accepting the or der the defendants were not in u position to question too plaiuun s right. The de cision is rassnred on s motion of the di- SMDattnab-Btjijjpinj fine*.
