ISOSBStSS?^ Which tre submit the fallowing comments : The distinction which our oowismpora- 17 referred to makes between an uncon stitutional and an invalid amendment, whetbsmSseestiy made or not', does not, in our judgment, apply to the /wo, so- called, amendments, which we hold to ' deeper and better discussion of soeiul and political issuer in all that w-tion Plan there has been for many years. We are glad Southern editors copy Mr. Stephens’ articles extensively. It is the best thing they ran jlo. and S®** it they had Iwst spur mennselMS up to' the discussion. It is more than high time the Si ith should devdefa a high class of literature. Her power to recover lier lost position in publid affairs is depen dent upon her intellectual prowess and not upon foreign aid or immigration. We lisve almost invariably found so much concurrence of seutiment lictween our own and Mr. Stephens' opinions tliat there has been no room for discussion between us. But, if we do not misun derstand his position, there is a differ ence upon the vital question of where the power resides which can rightfully judge of the constitnticinaUti- of false “ ““ )o th7m«dC$sUtntion. holds tlmiftii'bothejn- political qintios—that ia, _ P two imiifiss to test the constitutionality of tho fourteenth and fifteenth amendments, so-called. First, in an ap|jcal to the Federal Hujweme Court; ascend, In the event that remedy fails to declare them unconstitutional, to the States respectively. We understand Mr. Stephens to favor a resort to the Federal Supremo Court fiat. Neither of the turn late fraudulent, and, therefore, invalid amendments, ss we hold them to be, cornea within either of thasa restrictions, ao far us the objects aimed at by them are concern (si. It is true, the Vth Article of the Gou- gfllHfen wen taeet grossly violated, by a Revolutionary Faction in the Congress of f the Staten in the manner in which these amendments were proposed; and alio in the manner and mode in which they have been declared to be rightful parts of tho Constitution. Still, if those amendments bad boon gtroperly proposed, and duly ratified, in pursuance of both the letter and spirit of tiie Constitution, wo think they would be valid and binding upon all the Parties to the Federal Compact.— Wo think they art within “the sco/ir if ft* (intending Power,** if that Power had been properly and Constitutionally exor cised, and, whether the unloading Power lias been so exercised lly Congress, in tlio matter of these wOmfc'd amendments, is, in our judgment, as clearly a Judicial question ns tlio proper or improper cx- ettiso of any othor Power by Congress, in any case wliatever. This is, in short, oar view upon that question. We know that many eminent men dif fer with us, in this viow, and concur in the view presented by the Louisville Jeffersonian Democrat. We intend at present only to express clearly our own views on the subjoct, and not to discuss tbs subject. Under the reatristions of the Vth Ar ticle of the Constitution, the Federal Uaioa can never, by amendments, be changed into a Centralised Umpire. It is only by snob usurpations as marked the ‘history of these fraudulent amend ments that so calamitous a result need ever be apprehended; hence the impor tance of tho question touching their validity, both in a Jodioial and Political view. It is ia this latter view that it becomes a —“*■ of saoh vast importance that the Peoples of the United Water shall novel lion to the pal- sad iniquitous wrongs hp Stefa they are claimed to be valid parts of the Constitatioa, even if they should be held to be valid by the Cowrie. Now this is the real issue, and it is purely political The question oonoerns the reserved rights tf the peoitles ol the States. It is not a question between Stole and Federal (iovcmmsnt, but s question between the people of each Stole in their cotlectire capacity and all their pnblie functionaries and would-be mas- tors.
