Editors Sun: I aeo that some of tbe papers allude to the multiplicity of coun sel retained to prosecute all persons im plicated in tbe alleged frauds upon the Western and Atlantic Railroad, and I deem it not inappropriate to give yon some information upon that point. It is true that Hon. B. H. Hill and Judgo John W. H. Underwood havo been re tained by tbe Governor as general coun- 1 to aid in tlio trial of all parties before the Superior Courts after bills of indict- iient sliall have been found, and all other counsel have been retained by me iu mv official capacity as Attorney General, without dictation from any source. Be fore truo bills can bo found against any of the parties supposed to be guilty of these frauds, much work will havo to bo dono toward discovering and arraying the evidences of their guilt To assist me in this work more particularly, I havo em ployed Captain John Mi Hedge. Messrs. Gurtrell and Stephens have been rotainod in tlio prosecution of one case only—that of Mr. McCalln, and will prove peculiarly valuable to the prosecution in tluit case. Then there are five other counties on tho line of the road in which prosecution will probably be instituted, anil wishing to discharge my wholej.duty in these prosecutions, without discriminating for or against any one, and without giving the wrong-doers any advantugo of the State, I have felt it my duty to retain in each one of those counties at leust one of their most able and successful criminal lawyers. This is a necessary precaution from one single consideration, t%\vit: to prevent juries from being “packed” on us. All lawyers will concede tho folly of attempting u prosecution iu a county where all the lawyers iu tho prosecution are straugeis, no matter how ablo mid learned they may bo. Local counsel must be had, or the juries will be “pack od.” This is a lamentable fact, but it is nevertheless a fact. From these consid erations, and none other, I have retained Hon. Georgo N. Lester to aid mo in all cases iu Cobb county; General William T. Wofford in Bartow county; Hon. Wm. 11. Dabney in Gordon county; Colonel J. A. W. Johnson iu tho counties of Whitfield and Catoosa, and Col. James H. Anderson, in Chattanooga. And with a view to reaching every al leged fraud, and bringing every criminal to justice, whether he be rich or jxxjr, hiyh or loir, I request all good citizens, ou the line of the road, who know of any improper or criminal transaction in con nection with tho said rood, to communi cate it either U) my associate counsel in their respective counties, or to me, ns early as possible. They are retained only in thoir respec tive counties, and with the aid of gentle men who stand so high for personal in tegrity and professional ability, I trust that the people will rest assured that the prosecutions will be faithfully conducted against all parties, for I shall sock tbc aid of those only whoso past lives aro a sure guarantee of their integrity, and whoso professional success is proof of their ability. My motives may be impugued, but I quietly await ultimate developments as my triumphant vindication. It would be detrimental to the public interests for mo to pursue auy other course. Henry P. Farrow, Attorney General. ►*-* 21st, to raise funds to assist in complet- rpuE undersigned is pr«i ing their splendid now church.
