CoL Farrow, after readiug the affida vit, remarked to the conrt, thatthero was here an ordir for his arrest, hoing charg ed with being a common cheat and swin dler; that Charles F. Medulla had sworn to a lie, which he would prove during tbe day 1 He then said to tho Sheriff, “I am yonr prisoner;” nnd then asked the Oourt to excuse him for not, in his official ca pacity as Attorney General, prosecuting himself. At this point, at the instance of Maj. Hargrove, the Conrt issued subpmniB aud sent for nuverp 1 witnesses. While wait ing for them, there was considerable pri vate consultation between Gen. G&rtrell and Gapt Blodgett, in which Col. Far row participated. Muj. Hargrove rose and made a calm and dispassionate address to the Court, stating that he approached the work of conducting these prosecutions without any prejudice or imeeliug towards any one, but from solemn convictions of duty, and uunouncod himself ready for the in vestigation. Capt John Milledge announced that ho had been employed by CoL Farrow to as sist him in the pronecntion of allenfei connected with State Road investigations. He knew nothing of the facts—the evi dence—against Col. F., lmt thought the clmrgoA not well founded; but if ho is guilty, let him fall and be the first one to fall; that being thus employed ho would stand by tbe prosecution aud assist Maj. Hargrove all in his power till be should fall or the cloud had passed. Gen. Gartrell then announced himself as attorney for Col. F., and stated that he was ready to prooeed with tho ease. Maj. Hargrove proposed to postpone the ease till 2 o’clock, on account of the difficulty of procuring witnesses immedi ately. Col. Farrow said: No, sir! No, sir! to which Maj. H. replied he was ready to wait thero till the setting of the sen, and the rising thereof also, if necessary. I. P. Harris and C. P. McCaila were then sworn as witnesses on the part of the prosecution. Mr. Harris took the stand. Mr. Har grove handed him some pai>er8, purport- pig to cover a claim of Col. Farrow aguinst tho W. & A. R. R., for services from 1st January to 1st July. 1871. He then testified Umt he hod seen the paper. It was presented to him by Col. F. for payment about the last of July or 1st of August; told him I was not paying out any money then. Col. F. sai^l he had understood several thousand dollars would be paid into the State Road Treas ury in a few days, and would leayo tbe claim with mo till the money was roceivod and tho claim paid. This paper wns re turned to Ma. ltawsou, one of the Com mittee having charge of the State Road Books. Ooss-Kxamiued.-f-Col. Farrow wrote a note asking me to hand tho papers to Mr. ltawsou, which I did. When Col. F. called on me I stated to him that I understood McCaila making payments. Afterwards he told me that he*had received 8700. lie-Direct—I told Col. F. that I was not paying money; that I did not want to exhaust tho Treasury; but that if I received tho two or three thousand dol lar*, I would pur him. Question. I wonld rather have had the indorsement of the Governor. Msj. McCalls took tho stand. CoL JUadcott, in Jniy, told me that CoL Far row had a draft of 81,800, and requested mo to pay it. I did not then have tho amount; liut the day after I paid him 3700, taking a receipt. In August he osmo again, and I paid him $300, taking his receipt, in which I was particular to Bteta that it was part pay ment for a draft of 81,800. Here the papora which CoL Farrow had left with LP. Harris for payment, and which were subacqucntly handed to Mr. Knwaon, were shown to him. Question. Did yon see this paper be fore tbe books and iwpeni were turned over to tbo Committee r A. I did not. Q. Cross-examined.—I paid Other bills to other parties — don't know In what amounts. I authorized the publication of my late statement in The Dailt Sex. L 1*. Harris re called, and asked if he mould tovepaid the money on the nursed bill in its present form, to wliieh no an swered ho would not. It hub admitted hy tlw defense that this passed bill hsd never been before the Auditing Board ; and by the prosecution that tbe receipts taken by McCalls hod never been before that Board. E. E. ltawson, Judge Hammock and Foster Blodgett were then qualified bv the defense. Mr. Rawson state'!, in ref erence to the passed bill, that CoL Far row had given him a note for L P. Harris to turn over his claim for 31,800 to the Committee; that he hnd received it, aud it had been in the safe ever since ; thut be was present at tho consultation between CoL Farrow, Mr. Hill, Maj. Har grove and others ; that some differences of opinion sprung up. Msj. Hargrove : About the manner in which the papers got into the aafe ? Answer. Yes, sir. Msj, Hammock confirmed Mr. Hif' son’s testimony. F. hsd been employed or eousalted. He could not specify eny case, but knew they were numerous. It was his (witness's) duty to sign warrants without reference to tbe bill, but be would not have signed this one had he observed tbe {discrejiaocy in dotes. (Court adjourned till 2 o'clock.) In the afternoon session no other evidence woe introduced than the oontract between Ool. Farrow and Superintendent Hulbert, wherein for the consideration of 8300 per month. Col. Farrow was to act as attorney for tbo State Road daring the administration of Bullock; and a private letter from Col. Farrow to Maj. Hargrove iu referenoe to his (Col. F.'s) duties as attorney for tlio State Road, wherein ho stated that his position as Attorney General did not re strict him from accepting esses from other parties, tbo Western and Atlantio Railroad not excepted. Both papers were admitted in evidence. The case wss then argued by the attorneys, Gen. Gartrell leading. After finishing, he re tired to meet a business engagement, when Maj. Hargrove arose, and in behalf of the prosecution, the deceivod public and the defrauded State, made a manful, patriotic, Bcathing address, de nouncing those who, with a semblance of authority had, like thirsting vampires, fastened themselves upon the very vitalB of the State, extorted from the down trodden, taxed people, tho hard-won earnings of their industry. It was an effort abounding in burning irony and invective, and privately, was highly com mended by many present Here tbe prosecution was closed, and after the Court announced its intention to deliver its written opinion this morn- ning at 9 o’clock, Msj. Hargrovo arose and reminded tho Court that it onght to demand the retraction of tbe insult of fered the proeecutor by the pris oner this morning, or fine him for contempt of Court. CoL Farrow then arose and stated thut in respect to the Court he had withdrawn his assertion already, not that ho was mittaken in the statement, far he was ready to repeat it at imy time, but merely in deference to the Court Tho Court then adjourned, when Maj. McCaila instantly advanced towards Col. F., with his cane in s threatening atti tude, saving: Col. Farrow you hsve de nounced me as having sworn to a false hood, you sou of a b—h, or words to that effect, and struck him several times, breaking the cano and drawing blood from his hand at one of the strokes!— CoL Farrow drew his pistol, but did not fire or even present it, either being de terred by the bystanders, or having drawn it only to bo used in Belf-defence as a lost resort in an extremity. The spectators interfered and McCaila was carried away, while CoL Farrow, with some friends, remained in the court room. We heard a number of persons com mending McCaila for thus resenting an insult and vindicating bimself at tho proper time; and eveiy one whom we heard allude to tbe matter, condemned Ool. Farrow for allowing his temper to get tho better of bis judgment, und for uttering so gross and bo uncalled for an insult to Maj. McCalls. >-»■< MS T OH'S COURT. thirds of tho time every morning. The Court read out some charges und specifications ogainst Me., and among them was some thing about getting drunk and disturb ing citizens. At this point Me. stopped further proceedings by pleading guilty, and five dollars and costa were taken from his commutation money. Then to get rid of tho paint smell aud the hammering overhead of the work men, the Court adjourned, seemingly well pleased at the way the thing went off. ^ ./ Uullroad Hmsih-H]i. The up freight train on the State Road, when neal' Calhonn, night before last, ran i ff the track. Several boxes were smashed to pieces, and the track torn np. No one hurt. In cousequenoe of this the Daltoju ac- ooiamodstion, which is dae here at about 10 o’clock a it., did not arrive until af ter 12 yesterday. Markets, * Yesterday, business was an improve ment on tbo day before. Large qar.n- titiee of goods of all descriptions were shipped. Tbe draymen are kept busy. H. Eddleman appears in tho Constitution this morning, which charges me with circula ting reports about him, which ho says are false and mnlicious, and represents me as being unworthy of confidence, Ac. I desire notv only to say that I have not been circulating any reports about him, further then to state, on proper oc casions, the circumstances connected with his being arrested on oharges for which he will be tried before the courts of thb country on Monday next, when all t|ie forts will be given to th« public. Jobe O’Shieldb, Policeman. September 20,187L The Fire Last Night. At about fifteen minutes past nine o'clock last night the store occupied by George Deuo, on Peachtree Street, op posite tho First Methodist Church, was discovered to be on fire. The alarm was immediately given, bat before tho en gines could get to play upon it, the flames had so far enveloped the roof, as to render useless all efforts to save it The roof was of shingles, and very dry. The slock of goods on hand was con siderable, and consisted of an assortment of family supplies and groceries, all of which wero either consumed .or badly damogod. The building was owned by CoL C. B. Welborn, and insured. We did not learn tho amount of insurance on tho goods. Tho origin of the fire is a mystery.— An old negro woman who lives on the adjoining lot says a lamp exploded, caus ing tbo fire.
