Lost night after 11 o'clock, Messrs
Thompson A Petti bone, in J. C, Davis’

that there was fire in the basement under
their store, occupied as a beer saleoa tty
Mr. Heerlein. The alarm was given and
the Fire Companies were soon Oil the
spot. Meantime, Mr. Thompson, with
great presence of mind, collected some
help sud forced his way into the retrod the
Hhseffien t, and found a wooden jurtition
rapidly burning, which lie sooo extin
guished with s few buckets of water from
a pump in the back yard. The aause ot
the fire is not known. Mr. Heerlein had
gone homo some time before the fire was
discovered.

In March, 18C8, Lee, Executor of Hen
derson, obtained a judgment amneit
Carr, the complainant; tor 8,500 tw, oh
which an execution issued, and was levied
on Carr’s properly, and advertlaed tor
sale by tbe Hherin on the 1st Tuesday of
November, 1871; that on tho 4th ef Oc
tober, 1871, Rath Henderson, a judgment
creditor of Lee, whose judgment was ob
tained on tbe 20th of March, 1871, sued
Wilt a summons of garnishment againBt
Carr, requiring him to answer at the
Superior Court of Rockdale county on
the second Monday in March, 1872, what
he was indebted to Lee. The Court re
fused thn injunction, and the complain
ant oxeepted. If Carr's property had
been sold ss advertised, on tbe
first Tuesday in November, 1871,
and bail satisfied Loo's judg
ment against him, then lio would not
have owed him anything and would have
so answered the summons of garnishment
in March, 1872. But if tbe sale of his
property did not satisfy Lee's judgment
then ha could lmvn answered what
amount ho then owed Lee, after deduct
ing the nmautil which his property lev
ied on had been sold for, so that there
would bavo been no difficulty in protect
ing himself from having to pay the debt
twioe, ns tbe summons of garnishment
did not require him to answer nntil
March 28. end Leo's judgment being of
older date than tbe service of tbe sum
mons of garnishment, would have pro
tected him us Bgniust Ruth Henderson's
garnishment as to the amonnt of the sale
of his property.

This was a bill filed by the complain
ant against the defendants, on the 30th
of October, 1871, pray4ng for an injunc
tion to restrain tho collection of a note
thon in suit, and to restrain the transfer
of two other notes not tbeu due, which
the complainant did give to defendants
for the purchase of a -root of land, that
the chief value of aaid land was the
timber thon standing on it, wbsoh was
the main inducement in making tbe par-
chase thereof. Thai, prior to the sole of
the laud to tbe complainants, the de
fendants hail sold tbe timber on the land
to other parties withont bis knowledge.
The injunction was granted, the bill de
murred to for waut of equity, inasmuch
as thqaomplaioant hod au adequate and
complete remedy at law. Trie Court
overruled the demurrer and sustained
tbe injunction, whereupon the defen
danta oxoepted.
In view of the facts disclosed by tbe
record, there was no error hi the judg
ment of the Court below. The hill end
injunction were properly retained on the
grounds; llntf ft* the purpose of
restraining the transfer of the two
notes not due at the time of tbe
filing of the bill; aeoond, to provrnt a
multiplicity of suits, on the several notes
given for the land, as the same become
due, so us to have the whole eontreverey
between the parties, iq relation to the
sale of jaml, settled by the decree on the
fipsl hearing of (he bill
one party would furnish and the other
take afl t£o crude turpentine made on a
certain plantation, when delivered in
lota of 40 barrels and pay for the lota on
delivery, and if either party failed he
should forfeit 81,000.
Held, that the thousand dollars is to
be considered a penalty and not liquid
ated damages, and on the failure of either
party, the actual damages ore all tlutt
can be recovered.

2. The City Council of Atlanta ia lay
ing out or recovering pnblic streets, apb
as a court, and its proceedings can only be
proved by its records. Parol evidence of
its actum oannet be received.
3. In tbe absence of any formal aooep-
lance by'IHe public aUthdfttlM of tbe
dedication of a street, there must be
clear proof of a continuance and notori
ous user, for a reasonable time, by tbe
pablic, to constitute an acceptance.
4. Where there is controversy pending
between the public authorities of a city
as to the existence or non-existenco of a
public street, aad the public authorities
are temporary enjoined from opening the
same, by bill, rt l* not competent for pri
vate citizens, os such, to file a new bill,
pending tbe other to enjoin the obstruc
tion of the street, unless they show some
special damage to themselves from said
obstructions, differing fsaa the injury to
the public.
