Alter half an hour’s delay, Governor Watts and Judge Chilton being present, his Honor stated that he desired to hoar further ar*» gumont upon that point of tho Constitu tion of tho United States embraced in Article 3, Section 1st, first clause, which provides tho Judicial puwor of the United States shall ho vested in one Supreme Court, Ac,, an J especially upon tho points whether there is a constitutional obligation on Congress to cruato tribunals of inferior jurisdiction to the Sunremo Court at all, and whether tho word ‘‘may” in this Ar- tiolo of the Constitution creates a duty or merely imposes a discretion on Congress, and who'her-Con gross may not, as to these Inferior Courts, abolish them altogether, and il il can, whether this right doos not involve the los-er one of proscribing rulos by which jurisdiction, and especially thoir practice, shall bo controlled. His Honor stated also that if tho gontlcrnon repre senting the bar desired it, they might associate with themselves any others of tho Profession and he would gladly hear them. He replied that he would if desired, though ho thought that tho learned counsel had fully occupied the ground. After some consultation be tween tho lawyers, Judge B. F. Porter addressed tho Court, stating that as it might be delicate for his brethren who had conducted the discission to reply to his Honor's kind suggestion, he would say for himself and his brethren of the bar that the three gentlemen who had spoken for them have readied the apex, and hold tho temple. Tho points alluded to by his Honor wore then argued by Mr. White, Judge Watts and Mr. Chilton. J. Hrnitli, Esq., then replied rn behalf ol the Government. At the close of his remarks, of which we will give a report, with that of Mr. Whito’6 ?peecb, in to-morrow’s supplement, Judge I Iu stood Announced that he had made a partial arrangement to hear tho Bar of Mobile on the subject, and preferred to defer his decision for the present, especial ly a? he would not havo time to prepare iiis decision properly before his presence in thnteity would be required.
