ning's brigade, of which the decoseed was

was the longest we hare seen in the city
in yearn, representing all clauses, and In
cluding a number of colored people.
Close after the military, and immediately
preceding ihe hearse, was a close carriage
containing Rev. W. C. Hunter of the
Episcopal Church, and Captain Alai. G.
Morion, a surviving member of General
Henning's staff, comrade of the deoeased.
At tbe grave the Epiaoopal burial aarvioe
was read by Mr. Hunter, and the military
find a salute, and tba dead was left to
•leap on in droaedees slumber.

Sheriff Ivey is carrying around a peti
tion whioh is being generally signed,
asking that lha appointment of a jailor,
and feeding tha prisoners be restored by
the Legislature to the Sheriff. By an act
of 1872, these powers ware taken from
that officer and given to tbe Board of
County Commissioners. The Sheriff
merely asks that the constitutional rights
and the attendant feei taken from that
office by the set be restored. Our eitlaens
think the Sheriff ia correct in this view,
and henee some 230 people, comprising
bankers, lawyers aud leading men in
every class of buainaaa bars signed tba
petition. The Sheriff is required to give
a bond of *20,000 ; he is responsible for
tha safe keeping of prisoners, and it is
but just that he should have all Ihe per.

Colonel Mott tells us that Mr. Dow
Brown, who recently died, who superin
tended the Asylum gardens of 30 acres,

The following was read to the retiring
Cuuncil laat night:
Columbus, Ga., December 8, 1874.
To tlu Mayor and Council:
Gentlemen--As is nanal, I beg leave to
E resent this repott that your body may

tbe casus against the eity. While it ap
pears that tbe litigation it great, moat of
it ia hosed upon imaginary wrong*.
The cases of Chapman A Threewitn,
George Winston, administrator, and Oli
ver Williams with the oity are all old ones,
brought years ego to recover Ihe amount
of the city’s subscription to tbe Chatte-
hooobee Railroad and Banking Company.
Adding principal and intereat makes the
amount sued for about *10,000. These
cases were ones disposed of, bat a de
cision of the Snpreuie Court brought
them before th* courts again. From the
best information I oan obtain tha oity will
not lose anything by them. Compro
mises have been offered the eity, bnt no
action has been taken in reference to the
matter.
Within the past two years the follow
ing actions have been brought, and stand
on the docket disposed of as follows:
John 11. Hamilton ; notion on tbe case;
November term, 1874. Continued. Mr.
Hamilton olairna *11,090 damages from the
oity on account of aicknaaa to himself and
family occasioned by water standing in
tho large ditch on the east of the oity.
Marion E. Gray ; action on the ease;
November term, 1874. Continued. This
is e snit for *2,000 damages, Mr. Gray
claiming that amount in damages to his
property on Forsyth street by reason of
tho unskillful grading of said street.
Wm. Z. Lewis; damages for false im
prisonment ; November term, 1874. Con
tinued. Thia plaintiff claims he ia dam
aged lo tho amount of *2,000 on aooount
of being imprisoned by the oity polios in
tho guard-hones.
Cary llarefield ; damages for false im
prisonment; November term, 1874. Dis
missed. He claimed *5,000 for being
imprisoned in the guard-honse.
Wm. Mnnday, at this term of the Court,
received * 105 against the eity for feeding
hogs under th* “hag ordinance.”
Robert Badkins hoe two cases vs. tbe
oily—one claiming *250 damages for re
fusing to allow him to sell certain meat in
th* market, and the other a writ of Aabeat
ctrput, which is now in the Supreme
Court,
I have, during the year, prosecuted 38
cases before the Mayor's Court, and given
a number of written opinions to different
city officials who have naked it.
I would call the attention of the incom
ing Board of Aldermen to tbe faet that
tbe rights of the oity to regulate tbe mar
ket, the proceedings before the Mayor’s
Court, and oollectiou of tax executions,
are each imperfect and open to litigation.
I wonld, therefore, recommend that some
steps be taken to remodel the oharter of
tbe oity, and the varioa* amendments
thereto, at th* homing session of the Leg

The annnal report of 0. H. Williams,
City Attorney, was read.
Tha Mayor reported that in addition to
tbo *100 appropriated by Counoil, the
committee appointed had secured *70.60
for the Tnaeumbia cofferer*,, whieh
amounts, *170.50, ha had forwarded by
express to Taicumbia.
Tba Mayor added the annnal reports of
tbe committees had made the people fa
miliar with eity affairs and their manage
ment for the post you. W* have had no
calamtties. The floods of the spring did
some damage, but it has been repaired.
The Mayor's Court has bean used more to
prevent lawlessness and disorder than to
ooileot money for the eity. He returned
thanks to the officers of the oity, to mem
bers of Council for kindneaa, aid and
oonrtasy and to tha people for tha honors
oonferred upon him, and tha aid they
had given him in governing thia peaceful
oommanity.. [Applause.]
He then invited the Mayor elect to tbe
rostrum.
Mr. John Mollheuny aeoepted, and was

with some trepidation. I neither desired
nor intended to be a candidate for th*

have passed through, temper may be ex
hibited and animosity arise. If aueh be
the oaee, let them be forgotten. I cherish
ill feeling to none. I am Mayor of Co-
Iambus—the ontire city—end - will en
deavor to treat all, regardless of person,
class or condition, with uprightness, im
partiality and exaetness. Home may
apprehend that the present Coanoil
must he extravagant in expenditure,
because of th* general idea that
new coanoils mast do something different
from others to make them distinguished.
No extravagance need be expected; no
bonds will be isaned. From my oouverso-
tions, individually and collectively, I can
aay of the praaant board that it will ba a
modal of economy. No bonds ara to be
appropriated for any purpose. It shall
be my care to see that all offleers over
whom I have control do their duty. IT

oome with a well grounded obargs,
against a policeman and prove the charge,

The Clerk was instructed to have 150
copies of the annuel reports of Council
committees printed, and to inolnde tha
addresses of the retiring and the present
Mayor.
PETITION FOU COLOBED SEXTOE.
A petition signed by about ninety-eight
negroes, inolnding tbe pastors of tha two
oolored Methodist chnrohaa, waa read,
asking Conncil to appoint B. Forlar, ool
ored, sexton of th* oolored oemstery, in
stead of Wm. Wadsworth, tha appointee
of Mr. Odom, the sexton elaot of the eity.
The idea was that Porter was a good reli-
giuus man, and Wadsworth an immoral
one, ao the petitioner! aay. They give no
reason why h* will not make a good sex
ton. They seemed to forget, also, that
Columbus only haa on* sexton and Coun
cil holds him responsible. Tha oolored
•exton only is responsible te him. Conn
cil, however, received the petition .and
referred it to the Committee an Cemetery
hereafter to ba appointed.

gas works a wooden stable, for the two

usual rations be issued to the hones of
the Marshal and Deputy Marshal, waa
adopted.

Alderman Blanchard rose and in a very
humorous speech stated some new and un
sophisticated oases had beoom* one of us;
and in consideration of having had un
sought honors thrust upon him that all
the members who bad not bean connected
with tbe one just retired be allowed to
wiue aud supper those who had remained
in the Board at aueh time aa they might
select. Tbe motion was carried unani
mously. The new members ware not al
lowed to vote.
A new Alderman who put in hia jaw
was fined thirteen oigars.
