Ottawa, Ont., October 13.—Tlierc wuh •Vfreat excitement here this morning anion# the several government departments when ■word whs received from the colleetor ol customs at Halifax thut Captain Quigley, commanding the government cruiser Ter ror, had hauled down the stars and stripes which were floating at the masthead of the United States fishing schooner Marion <1 rimes, recently seized at Shelburne, N. S., and held for the sum of fiOfl for an in fraction of customs laws in entering Shel burne harbor for shelter without re porting at the custom house. Pro in information gathered at the marine and fisheries department, alepartment ofeustoms and the department of justice, to which department the case lias been referred, it is clearly evident that the captain of the government cruiser has been over-zealous, and has consequently committed a grave error which may seri ously embarrass the government. The customs laws provide that only when a vessel is seized for smuggling is Hhc liable to confiscation, in which case she would become the property of the crown. Then, and then only, it uppenrs, would an officer of the dominion government have the power to prevent any foreign vessel flying tier national flag. EXCEEDINO HIS AUTHORITY. The captain of the Marion Grimes,'as represented by the custom department here, was only guilty of the minor offence of having entered the harbor and attempt ing to leave without entering at the cus tom house, for which offence he could only be detained until the deposit of (400 had been made with the collector of customs pending an investigation into the facts of the case. In the case of the Marion Grimes, therefore, she was not subject to confiscation, consequently she did not • become the property of the crown, in which case Captain Quigley had no power or authority to order Cap tain Landry to haul down the flug of the United States, which, by the way, ho re- fbsed to do and which only oame down when Captain Quigley look hold of the halliards himself. The vessel, as the nbove facts will show, was only sub ject to detention. She was not a British vessel and had not reverted to the crown, but was as much as ever, in Hie eyes of in ternational law, an American vessel. CAPTAIN QtUOLKY TO BE INVESTIGATED. The question of Captain Quigley’s justifi cation to interfere with thu flag of a foreign nation under the circumstances cited has been referred to the minister of J ustice for an Immediate report. The foregoing facts are substantially those as gathered from the ministers and head officials of the various departments interested. It is quite evident that the government recog nize the gravity of the mistake made. SECRETARY BAYARD’S “DEPRECATES.” The statement published to-night that khe state department at Washington depre- a-ates the action taken by Captain Landry, of the Grimes, in running up the Ameri can flag, lias proved a great source of re lief to the heads of departments here, who were made responsible by the action of the government officers. The state depart ment appears to justify the action of Cap tain Quigley, of the government cruiser, on the ground that the same course was followed when the United States revenue ■cutter Corwin seized the British vessels for taking seal In Alaskan waters, when the British flag was at once hauled down. In this the slate department appears to find a f ireoedent. The two eases are not parallel, n the case of the seizure of the British vessels they wore seized for scaling, as was ^alleged, in American waters, for an infrac tion of treaty rights and subject to eontls- •oation, whereas in the ease of the Grimes ■ she was only detained fora minor violation of customs laws and subject only to lino, if the case, on investigation, was proved against her. Had the Grimes been caught fishing within th ■ three mile limit, in vio lation of I maty rights she would have been subject to confiscation, as is alleged of the ..British vessels seized by the Corwin. We wore all ■wutching him as intently as our pains would let us. Fat her stood with the pad dle uplifted. Bob continued iu bis leaning position, holding the half-dollar between his uplifted fingers, with that grimace un alterable on his face. Bob was as cool as a cucumber.
