Simon Loughman, of New York, has
been commissioned commissioner of deeds
for Georgia.
Rev. J. H. Dixon, of North Carolina, has
accepted the call of the Presbyterian
church of Gainesville.
The gin house of Mr. A. H. Brown, of
Campbell county, with sixteen bales of
cotton, was burned last Sunday.
Sallie Doniel, colored, died in Taylor
county Wednesday of poison criminally ad
ministered by Martha Green, also colored.
The election on the water works ques
tion in Dalton Saturday resulted 262
against and 94 in favor of issuing bonds to
build them.
W. T. Moze has been arrested at Macon
on suspicion of being one of the
parties who robbed C. M. Mosely’s safe in
Montgomery connty in July.
Cobb county has an old gentleman and
wife who are 80 years old, been married
nearly 60 years, raised 9 children and nev
er had a death in their family.
The gin house of Jas. P. Smith, near
Irwin’s cross roads, Washington countv,
was burned with two bales of eotton and’a
thousand bushels of seed. There was no
insurance.
Gilbert Hodges, a negro on the place of
the late W. G. Sims, near Hogansville, was
cut with a knife and killed by Aus. Wis
dom. The slayer lied and has not yet been
apprehended.
A reward of 8150 was offered by Gov
ernor Gordon Saturday, for the arrest of
Isaac C. Hicks. Hicks is charged with the
murder of Andrew T. J. flrovvr, in Carroll
county in September, 1872. The murder
was unprovoked and horrible, the victim’s
body having been frightfully mutilated
after death.
Governor Gordon commissioned the fol
lowing justices of the peace Saturday: G.
W. York, 911th district, Cobb county; C. H.
Anderson, 44th district, Bulloch county;
Monroe Bennett, 1351st, district, Forsyth
county; Robert Whitfield, 1893th district,
Johnson county; P. M. McCurdy, 464th dis
trict, Newton cou ity.
Several nights ago, Conductor Loftain,
in charge of freight train No. 35. bound
south, was standing beside a car, at Port
Valley, while the engine was drilling a
number of other cars on to a side track
nearby. When the- train finally.started
forward, the wheels of the car by which
he stood, passed over a torpedo lying on
the rail, placed there with malicious in
tent, causing it to explode. A portion of
the deadly missile struck Mr. Loftain upon
the knee-cap,completely shattering it, and
rendering him for a long time insensible.
He was put aboard the train and taken on
to Amcrreus where Dr. Port, who had been
wired for, met him at the depot and at
tended his wounds.

Samuel M. Hendricks has heen appointed
superintendent of education for Blount
county.
A gin house belonging to Mr. Wm. Pul
len, of Cullman county,"was burned a few
days ago.
Tim Stone, the negro convicted of an as
sault with intent to murder on William
Pollard a few nights since, in Birmingham,
made his escape Saturday evening.
Mr. Sam Penney, of Greenville, was
killed Saturday while superintending roll
ing timber on Pigeon creek. Mr. Jones
was crushed by the same log, and is proba
bly dead by this time.
Mr. Bolz, a well known drayman of Bir
mingham, broke one of his arms rather
seriously Saturday. He was crossing the
dummy line at Twentieth street, when the
tongue and bed of his dray became un
coupled, precipitating Mr. Polz to the
g round. One arm was rather seriously
rokeu and several painful bruises were re
ceived.
Thomas W. Ellis, of the Birmingham
Hornet fame, who has been confined in
the insane hospita; at Tiukaloosa, was on
Saturday taken before Probate Judge
Brown on a writ of habeas corpus and was
discharged from the custody of that insti
tution. It will be remembered that Ellis
was tried a few months ago in Birming
ham for killing Clara Itoss, and was ac
quitted on the plea of insanity and sent to
the asylum. The testimony of the asylum
officials was convincing that he is not now
insane, and .Judge Brown accordingly
ordered his discharge. Ellis managed his
own case without the help of a lawyer,
and is said to have conducted it with skill.

build a hotel is being agitated.
The Orlando Guards are making prepa
rations for the formal opening of their new
< armory.
A 1 ttle too much intimacy with a saw at
Griffin’s mill Friday resulted in the loss of
a thumb to P. O. Carter.
Burglars entered fhe store of C. C. Wait
at Reddick, fifteen miles north of Oeala,
Thursday night, and stole $400 wortli of
goods.
Many of Lake City’s citizens are so well
pleased with the Japan persimmon that
they wifi plant it liberally this winter.
The sweet potato crop in Leon county is
said to be immense this’senson. One fanner
expects to get 2,000 bushels from a nine-
acre patch.
A building and loan association was tem
porarily organized at Ocala Wednesday
night. Two hundred shares have already
been taken.
Pierre Lorillard is expected at St. Augus
tine some time next month. He will leave
Now York on his own yacht, which on ar
rival iu the harbor wifi drop anchor for
the season.
On November 5 the First National, bank
of Ocala closed its first half year of exist
ence. In that short space of time it has
exhibited a net earning of 6 per cent, on
the capital stock.
J. R. Jennings, of Jasper, has just come
in possession of an old English watch that
has been owned in the Jennings family
more than 125 years. It still keeps correct
time.
A gang of five white men were discov
ered in an old cabin near the Sink, at
Gainesville, Thursday, where they had a
stock of various kinds of goods, besides
several Winchester rifles. Sheriff Collins
got together a posse and started out to
arrest the gang on a search warrant
sworn out by C. G. Waits, whose Btore at
Reddick was burglarized a few nights
ago. A negro boy promised to conduct
the officer aud his men to the rendezvous,
but played traitor and went to the cabin
ahead of the posse and gave the whole
thing away. When the sheritf and his
men arrived all was quiet and serene, the
tramps having decamped. They are sup
posed to be still lurking around Gaines
ville.

Said corporation lo have power ami authority to
sell, lease orient its said water power, lands, ma
chinery, facto its and buildings, or such parts in cl

sons or other corporations as it may deem lit and
proper; and to advance from its corporate capital,
funds to such persons or corporations as may oc
cupy its said property; to aid and promote thi
carrying on by them of their said manufacturing
business, and to make and execute all necesi ary
conveyances and otln r instruments, and to enter
into all proper contra els u nr. agreements for the
exerche ol this authority and the securing of its
said advance s.
Also, to have power and authority to lay out
ph ts and building lota upon the lands which may
be hereafter acquired by said corporation in the
States of Georgia and Alabama; to erect buildings
and improvements thereon, and the said lots, va
cant or improved, and the said buildings, to sell
rent or h a e to the operatives of said manufac
turing enterprises, ami to sucli other persons as
may desire to rent, lease or purchase the same.
THE PRINCIPAL PLACE OF BUSINESS
of said corporation will be located at the site ol
its said mills and wuter power in Muscogee Coun
ty, State ot Georgia.
ITS CHIEF OFFICE
to be in the City of Columbus, of said County and
State; but lt’shall have authority in pursuit, of its
said business aud promotion of its objects to es

exercise its lights: ud franchises heretofore men
tioned, and to build actorics, make improve
ments, contracts, agreements, investments and
carry on business of the nature and character
afore mentioned with regard to its property and
upon the lands and property which may be liere-
aiter acquired by said corporation in the State of
Alabama, and at such other places within and
without the limits of said States of Georgia ana
Alabama, as its objects and interests may re
quire.
THE CAPITAL STOCK
of said corporation shall be one hundred and fifty
thousand dollars, payable in money or property,
us said corporators may determine, to be divided
into shares ol©100 each, ol which amount ten per
cent, thereof shall be paid in before said corpo
ration commeuc. s to uo business; and petitioner*,
desirt a aid corporation shall have authority to in
crease said capital stock from time to time as it
may deem tit und proper to any sum not exceed
ing one million dollars,
They desire said corporation to have the power
of suing and being sued; to have aud to use a
common seal, and to alter, break and change the
same at will; to make rules and by-laws lor the
management of its business, not in conflict with
the laws of this State unit the United States, and
the same to alter, amend and rescind at pleasure:
to receive, lease, rent or purchase and hold such
real estate and personal property as may be now
oi hereafter necessary for its corporate purposes,
for the expansion unci advancement of its objec ts,
for the securing of debts due and to become due
to said corporation, and the same to sell, mort
gage and convey at will.
That it have power to effect loans and to issue
bonds iu the name of said corporation, without
security «>r to secure such bonds by mortgage oi iu
property, rea> and personal, or t of sucli parts or
portions thereof as may be desirable; and to loan
out its surplus earnings upon mortgage or other
available security.
To elect and appoint such officers, managers,
directors and agents us it desires; and to provine
such rules and regulations witn respect to stock
holders who refus-e to pay up any balance due on
their stock as will Compel them to pay upon pen
alty ol't-alv or forfeiture of such stock, and to do
und perform all such ueis os are necessary for tin-
execution of its powers and to carry out the ob
j ecus and purposes of this corporation.
The individual property of each stockholder
shall not be liable for the debts, liabilities, obli
gations or default of said corporation except to
the uniuuut of unpaid stock subscribed by sucli
stockholder.
Wherefore petitioners pray that they, their as
sociates and successors be duly incorporated un
der the name us aioresaid for the term of twenty
years, with the privilege of renewal, with ail the
p -wers herein prayed for, and with such other
powers and privileges as are incident to corpo
rations under the laws of this stale, and that af
ter the filing, recording and publishing of this
petition, as provided by law, the Court will pass
an order declaring this application granted.

office and place of doing business is in Columbus,

That the original charter and act of incorpora
tion was granted by the'General Assembly of
said State by an Act entit ed ‘ An Act to incorpo
rate the Eagle and Pheiiix Manufacturing Com
pany of Columbus. Georgia,” which act was ap
proved lotti of March, I860.

for the election ol more than five Directors, not
has there been any change in the law? respecting
said corporation.

annual elections, choose nine directors among
said stockholders instead of five, as provided by

Wherefore, your petitioner prays that an order
may be passed at the next November term of said
Court declaring said petition granted, and that
the Fourth Section ofsuid Act Briall be so altered
and ament'ed as that the same sha 1 read as fol
lows:
Sec. IV. That there shall bean annual meeting
of the stockholders of said coiporation at such
time and place as the corporation may provide b*r
its by-laws for the purpose of electing nine direct
ors. and that the time of holding the first meeting
of the directors under the said first election shall
be fixed by said directors, or a majority of them,
and the said directors chosen at said election, or
at the annual election to be afterwards held.shall,
as soon a** may be after subsequent elections,

of the death, resignation or removal of the presi
dent or any a irectore, such vacancy or vacancies
may be filled for the remainder of the year where
