poople of the 8th Militia District of Mus
cogee county have acted with commenda
ble spirit and promptness in the work of
organisation for homo defence. In a
few hours, last week, they raised a caval
ry company numbering over sixty mem
bers, electing Dr. Cheney Captain. The
company will have a meeting for drill
on .Saturday next. Only three or four
of its member- are under forty-liro years
of age, being exempts. It is desirable to
have in tho company twolvo or fifteen
young rnon as sharpshooters, ami it is
hoped Chat that number of non-conscripts
will be obtninod. Cannot some of the
youug exempts of this city aid in giving

Discharge of Pettlugl!!.—In our Su
perior Court, yesterday, Ephraim Pettin-
gill, the young man on trial for incen
diarism committed in this city, was dis-
ohargc4»on the ground of insufficient ev
idence of his guilt. It will bo remem
bered that Pettingill, on his examination
n few weeks since, mado a lull confession
of complicity in tho burning of Richter's
shoo shop and other buildings in this city
last winter. We learn that ho was dis
charged in accordance with a provision
of the new code, which prohibits the con
viction of a defendant in a criminal ca-'o
on his own confession merely.

which rosulted in the death of Van-Dorn
was an interview hold thirty hours pro-
vioiu to the killing, in which tho latter
agreed, on his honor, to give Dr. Pv.crs
a written statement tho next day setting
forth four distinct fact-. l>r. Peters
said to him that upon the fuilllmcnt of
tliis promise Vie would spuro-hm life t“ his
wifomml children, although Van-Dorn
said he cared nothing for his own wife.
The next day Dr. Peters \va> rick. and did
not call on Van-Dorn until tho second
day, (Thursday morning, about c'uht.)
when he demanded of Van-Porn a com
pliance with his promise, which I10 seem
ed not inclined to do. Dr. Peters then
said that he would give him half an
hour in which to comply, and distinctly
notified him that, in case of failure, ms
life should he the forfeit. He then
walked up into tin* village. On his re
turn Van-Dorn road to him what lie had
written. Tho first clauso fully complied
with his promise, tho second was an en
tire mis representation, aud tho other two
acknowledgements ho refused to make.
Dr. Pe ers then denounced him for his
bad faith, when Van-Dorn cursed him lor
a "cowardly dog,” and ordered him to
leave tho room or lie would kick him
out. l)r, Peters then drew his pistol and
tirod, the ball hiking otVect in the left
side of tho head, and producing instant
death.
Dr. Peters nicked up tho statement
Van-Dorn bad prepared, and ha-, pre
served it ns circumstantial evidence of
preceding events, and, mounting his
horse, roao otl'. Avoiding tho pickets ut
Hurt's, ho crossed Duel; river and arrived
at Shelby villo, when ]»o learned that Gen.
Polk, to whom he had intended -m ren
