This farm was ] — owned by Mrs. Austin, purchased from her brother, out cf money inherited from her J iather’s estate. Austin, it is said, desired to possess himself of this farm, and used all en- «i»'f»vors to have it transferred to his name. Airs. Austin resisted, expressing her belief that Austin would desert her and the children if she consented. The statement goes oa to .harge, that failing to attain his ends in *hi3 particular, Austin determined to murder his wife and so obtain possession of the land in that way. Hearing the noise cf Austin’s entrance, by the ontside door, which was evi dently not the nsnil mode ot entrance, Haley arose from his own bed in an adjoining room and passed into Mrs. Austin’s bed chamber, where Austin was concealed in the darkness, .0 ascertain the cause of the alarm. Just as Haley reached the centre of the room, Austin Voce and fired three shots. The statement has it that Austin im-. mediately sent for the relatives of his I dying wife, and his neighbors, and “assumed the role of the injured husband.” He at-1 tended closely by the dying woman, who I mast have suffered exernciationg agony for j those five lingering hours of life, and frus-1 (rated all opportunity oa her part to make a statement. A11 that she said was, just before slie died, “Ob, Mr. Austin, why didn’t you kill me outright and save me this awlul ago- uy?” Well might she say so ! In any event, whichever of these two statements may be correct, well may she have said, “Why not kill me ontright to save me this awful agony ?” Mrs. Austin is reported by this statement to have been devotedly attached to her bus- hind, but opposed to his possessing himself of the property, for the reasons previously given. She is also repo: ted to have expressed a fear that Austin would kill her about it. They were in St. Louis at the fair ia 1872, on a visit to friends oa Olive street, and her fond ness for bim was frequently the subject of remark. In a case of such terrible results as this, where so much of rep aration is at stake on both sides, judgment has no basis short of the truth.
