code.
The fight Is being mode by Attorney
William E. Simmons, of Lawrencevllle,
In behalf of M. L. Rockmore. for the
use of th* Bank of Lawrencevllle
against the Hartford Fire Insurance
Company.
Th* statute In question. No. 2.140 of
th* code, provides that when a Are In
surance company refuses to pay a claim
within sixty days after demand la mod*
and shows bad faith, the Injured party
may secure as damages 26 per cent of
the amount Involved, besides reason
able attorney fee*.
Tho suit now pending Is for 23,090, It
Is claimed by the plaintiff that although
the supreme court of Georgia has held
the statute unconstitutional, such In not
th* cane, and that the law la a good
one. In support of thla, decision* ot
the United States supreme court are
quoted.
There Is a Jury already drawn to try
the ces* should Judge Newman over
rule the demurrer made by the insur
ance company.
