Bowling Green, . Ohio, July 17.—Jane
Stone, of Brooklyn, probably the largest
woman oil operator In the world, today
filed an assignment In the supreme
court here* Charles W. Soleter Is made
assignee.
The deed covers 612 acres of land In
Douglas county, Georgia, 47 acres In
Carroll county. Georgia, and extensive

ing of the city council and board of
aldermen last night, to take action In
regard to reimbursing the Greeks for
the wanton destruction of their res
taurants on Saturday night, resulted In
a resolution on that question being re
ferred to the finance committees or the
two bodies.

We have, therefore, tho Central Rail
way Company swearing, through Its
vice president, that Its tangible prop
erty. located In Georgia, exclusive of
Its franchise, was worth 333,666,999 as
a basis for taxing the people ot Geor
gia with freight and passenger rates,
while It only paid tax to the state on
Its tangible property and franchise In
cluded at the estimated value of |18,-
351,688. This same company Is now
resisting an assessment made by the
comptroller general upo nits tanglblo
property and franchise at $29,988,120.
The Southern Railway Company.

dent, that Its property, located In Geor
gia, excluslvo of Its franchise, was
worth $48,150,000 as a basis of taxing
the people of Georgia with freight and
passenger rates, only paid tax to the
state on Its tangible property and
franchise Included at the estimated
value of $14,277,500. It Is now resist
ing an. assessment made by the comp
troller general upon Its tangible prop
erty and franchise at 220,500,000.
The 8tate’s Advantage, .
The law of our state provides that
where the comptroller general Is dis
satisfied with the roturn of a railroad
company for taxation he can assess the
property. If the railroad company Is
dissatisfied with his assessment, the
railroad company names an arbitrator.
Tho railroad can select anybody It
pleases as arbitrator. It ca'n employ
a man trained to the work, and furnish
him full Information to represent Its
aide. The comptroller general Is re
quired to select a railroad commis
sioner. If the two do not agree, they
select a third arbitrator, or umpire.
Tho arbitrator representing the rail
road company has the benefit of the
fullest consultation with the officers of
the railroad company, and the aid ot
their machinery to pick the third man.
The railroad commissioner, acting as
an Incident to hts office, largely by
himself, has not advantages equal with
those of the railroad arbitrators in se
lecting the third man.
8hould be Under Oath,
I And no provision of law which re
quire# the arbitrators to take any oath
to ffx the true'value of the property and
none which allows them to swear wit
nesses. If „the arbitrators were re
quired by law to fix the true value of
the property, and If they had the right
to swear witnesses, the state could call
before the arbitrators the officers of
the company, the property of which I*
to be taxed. All the officers who would
be authorized to swear to a bill fllcd to
enjoin a freight or pnssenger reduction
could be put upon the stand and tho
railroad company could be forced to
take the same basis of value for Its
property when It pays tax that It sets
up In a bill before a court when It
seeks to maintain a valuation as a basis
of taxing, through freight and passen
ger rates, the people of the state.
Let me refer again to the Southern
Railway Company. It paid taxes last
year to the state upon Its tangible prop
erty and franchise at only $14,277,600.
At the very same time It wss litigating
with the state or the railroad commis
sion of the state, seeking to enjoin the
reduuctlon of freight rates, claiming In
that litigation that Its tangible prop-

erty, exclusive of franchise, was worth
$48,160,000.
Discredits Valuation,
I do not believe that the property of
the Southern railway In Georgia Is
worth any such sum, but I do Insist
that the railway company should pay
tax to the state at the same valuation
of Its property which It Is permitted to
sustain before, the courts as a basis for
taxing, through freight and passenger
rates, the people of the state.
Should Broaden Scope,
I have not before brought this mat
ter to your attention because I had
hoped that an act would ;bo passed on
this subject In time to meet tho arbitra
tions about to take place. Such legisla
tion would have been remedial In na
ture and clearly legal. It Is now Im
possible to broaden the scope of the
selection by the comptroller general of
an arbitrator, but still It might be pro
vided that the arbitrators should bo re
quired under oath to And the true value
of the property assessed, and they
could also be given for their present
hearings the power to swear witnesses.
I am aware that there Is objection to
tho entire plan of arbitration; that
many believe boards of assessors should
exist as to all properties, clothed with
authority of hearing and determining
the true value of property to be taxed.
It may be that auch legislation will be
passed at the present session. It Is
hardly necessary for me to suggest that
such legislation, to be free from consti
tutional objection, must provide for a
hearing on the part of those the value
of whose property Is to be Axed for
taxation. In any event until such leg
islation may become effective, I re
spectfully urge the necessity of amend
ing the pnsent machinery used by your
executive officers to Ax the value of the
property for taxation which tho law re
quires returned to the comptroller gen
