against Augustus.D. Adair. George W.
McCarty and James D. McCarty, as
owner* of the Chlckamauga Fertiliser
works. •
The, bHl alleges that the defendants
are making use of the word “home-
atend” In connection with a brand of
fertiliser and this is declared to be a
copyrighted name. It ts further alleged
that the defendants gnvs a cheaper and
inferior grade of fertiliser under this
name and "deliberately and fraudulent
ly sold to the public and purchasers
thereof for another fertilizer, both of a
higher grade and price, and the pub
lic* le thereby cheated and defrauded

son und Htephen Dorsey, negroes, were
put to death In the electric chair here
today. They were convicted of mur
dering a woman and her servant In or
der to rob the house. A note written
by Gibson was found In his cell, In
which he said he alone t-as guilty of
tho murders. Dorsey proclaimed his
innocence to the end. Gibson said he
could not die without telling the truth.

white man, when Recorder Broyles
Tuesday morning fined him $50.76 for
being drunk.
The raze waa peculiar, however, the
main charge against McDonald being
forgery. He was accuaed of forging
his mother's name to a check for $5,
but Mrs. McDonald nppeared In court
nnd atated sha'liad given her son au
thority to sign her name to chocks. An
official of tho bank, -In which .Mrs.
McDonald deposits her money, (estl-
fledt however, that the bank had never
boon notified of any such authority and
stated that tho signature of Mrs. Mc
Donald was the only ono they recog
nised.
"Well, Mrs. McDonald testlfles she '
