PRESIDENTIAL PRIMARY
RESOLUTION AS ADOPTED
Her# is the resolution proposed by
pleasant A. Stovall, of Savannah, and
amended by W. H. Burwell, of Hancock
county, providing for a state-wide pri
mary election to be held by Georgia
Democrats between the middle of April
and the middle of June, on a date yet to
be determined, .which was adopted by
the state Democratic executive commit
tee at its session in Atlanta Tuesday
afternoon:
"Whereas, in the year 1912 the presi
dential election will be held and the
Democratic party will be called upon
to present candidates for the offices of
president and vice president of the
United States, and
"Whereas, this committee Is charged
by the party with the duty of providing
the machinery by which the Democrats
of this state shall express their choice
for these high offices, and
"Whereas, so far as this committee
Is advised the states of North Dakota.
Wisconsin, Nebraska. Oregon and New
Jersey a,re the only states which havo
so far fixed any dates for party action
upon the Choice of candidates for presi
dent and vice president, and none of
these states ha* fixed the date for such
action earlier than March 19, 1912, the
other states named having fixed various
later dates In April and May for such
action, and
“Whereas, in the opinion of this com
mlttee It Is now too early for the party
to take final action as to its choice for
these offices, a* It is Hot known at the
present time who the candidates will
bo or when the national convention will
be held or what Issues will he loft
pending toward the adjournment of the
present congress, and
“Whereas, the Democrats of this
stato should be allowed to express their
choice between the candidates at a date
late enough to enable them to Intelli
gently pass upon ail issues and all can
didates, therefore be It
"Resolved, That It Is the senso of this
committee that the Democrats of Geor.
gia be afforded an opportunity of regis
tering their choice for candidates for
president and vice president of • the
United States by direct primary elec
' on, the same to be held not later that
me 13. 1912. .
“Be It further resolved. That this
committee will meet on the .second
Wednesday In April. 1912, to arrange all
tho details for holding the said primary
election and all the details In relation
to tho calling of the special convention
to select delegates to the national Dera-
ocratlc convention.”
Suit Scheduled To Be Filed
Tuesday by the Department
of Justice.
Washington, D«c. 12.—Suit win be
filed late today or tombrrow by the' de
partment of justice against the Nation
al Shoe Manufacturing Company, 'the
shoe trust with headquarters at Bos.
ton, as a monopoly in'restraint of trade.
The papers in the case have been sent
to Federal District Attorney Asa French
at Boston.
The specific allegations in the gov
ernment's bill follow those that have
been filed in most of the government’s
trust-busting prosecutions.
BOOKKEEPER ON STAND
IN JOHN_KNIGHT TRIAL
Huntsvills, Ala., Dec. 12.—With the
examination of J. B. Darling, book
keeper for Knight, Yancey & Co., ti»i
prosecution rested its case against John
W. Knight, In the Federal court at It
o’clock today, and the defense placed
Darling back oi\ the stand as Its first
witness.
Darling’s testimony showed that
Knight did not draw much money out
of the firm for his services during the
isat year of operation, and that his ac
count was kept straight.
Auditor Leatham, who was on tho
itand yeaterday, was recalled today. He
testified that the firm was insolvent
on November 9, 1909, to the extent of
nearly >2,000,000, when Knight made a
statement of Its condition to Vanger-

Morgan Shuster, the American,
Will Not Be Ousted From
Office, Either.
Berlin, Deo. 12.—Dispatches from
Teheran today stato that Morgan Shus.
ter, the American treasurer general of
Persia, will 1 keep his position and that
Russia will immediately withdraw her
troops from Persia. Russia is said to
have acceded to Persia’s picas to be
permitted to keep Shuster, at the head
of her finances. On the other hand,
Russia receives assurances that here
after no official appointments will be
made by Persia until thoy hdvO been
approved by both Russian and English
authorities.

The Tallulah Falls Conservation asso
ciation is making arrangements to open
headquarters In Atlanta. An expert man

for the purpose of conducting a vigorous

railway machinist, ended his life this aft

eighteenth floor, dashed across the corri
dor In the presence of two men, mounted
the rail and leaped off. On his way down
Greek’s body hit an‘iron rail a.nd his left
arm was cut off.

In the wreck of a cigar stand on the main
floor the crowds in the building were in a
panic; one man was found unconscious
from the Impact of the body which brush

Three of Famous Rider’s Chil
dren Die in Germany Within

News was received In Atlanta Tues
day morning, of the death in Germany
of two of “BbbbyV Walthour's remain
ing children, from tho Illness with
which tho entire family of the noted
bicycle rider was.attacked. Mrs. Wal-
thour Is also seriously ill and Is not ex
pected to live.'
Mr. Walthour lost his eldest daugh
ter about a week ago, and the death of
the other two children following ho
closely upon hers is a sad blow to him.
He was one' of Ihe most popular of
Atlanta athieteg^t the time he raced
In Atlanta, his homo, town, and has
hundreds of friends hero who will be
saddened to learn of his distress.

will have passed into history. .
Tho case really ended in tho IPulton
county- court of ordinary Tuesday at
noon, but tho formality in tho record
er’s court must he adhered to, and. so
Hub won’t get his name off the court
dockets until the’rccorder gives him 60
days for the numberless cases pending
against him at the' Dccatur-st. palace
.if Justice.
The settlement framed up by Lowry
Arnold, of the Atlanta criminal court;
Hugh Dorsey, solicitor general; James
L. Mayson, city attorney; Talley’s rela
tives, Talley himself and the long-suf
fering Judgo Wilkinson, nearly went to
the bad In tho ordinary's court, Tues
day, when some of Talley’s relatives
insisted that Hub be tried for lunacy.
Jt lmd been cut and dried for the lunacy
writ to bo withdrawn and Talley to
plead guilty to the cHargcs In record
er's Court and let the other cases
against him be quashed.
So confident were the authorities that
the scheme would go thru without a
hitch that neither Lowry Arnold nor
Hugh Dorsey appeared when the trial
was called before Judge Wllkinsoh.
To the relatives’ intontlon to proceed
with the lunacy hearing John Y. Smith,
acting for Hub himself, objected, as no
witnesses were on hand. After a long
wrangle tho parties concerned .got to
gether and tho settlement went thru as
planned.

orected hero by Henry Nyberg, presi

of Anderson, Ind., and Chicago.
Mr. Nyberg, it Is understood. Is now
on his way South and will be in Atlan
ta Thursday morning to take up the af
fair* of thr*-n»MY factory. II** expects to
have things In shape so that Atlanta
will be turning out Nyberg cars in 60
days. A site suitable for a factory
has not been selected, but It Is under
stood that negotiations have b*»en open,
