refusing to grant the vrrH against Po-
lh*e Judge Mct'ann. of this city, to
force hltn to retry cases against saloon
keepers who violated the 8unday clos
ing law, waa handed down at Frank
fort yesterday by the court of appeals.
The court held that section 1803 of
the Sunday closing law*, prohibiting the
sale of liquor on the Knhbath, la consti
tutional, thus preventing any saloons
The effect of this decision Is to make
the law operative In the future. The
court was evenly divided on the ques
tion of granting the writ, but unani
mous In holding the law constitutional.
