New York, July 5.—Details of the
breach of promise suit which Evelyn
Neiblt Thaw contemplated bringing
against Harry K. Thaw sereral months
before their marriage were revealed
today. The district attorney's office
traces to this action the motive for
killing of Stanford White.
The prosecution has been Informed
that Thaw believed Stanford White In
spired the suit An affidavit made by
Evelyn Nesblt to be used In the suit
Is In possession of the state and wit
nesses have been found to whom the
young chorus girl. In a burst of confi
dence, showed love letters from Harry
Thaw, on which the suit was baaed.
8he Feared Thaw.
According to the facts related to the
district attorney, Evelyn Nesblt left
Harry Thaw in Paris because of his
erratic and cruel conduct She feared
him and returned to New York, taking
upartments In a Broadway hotel. Sho
had with her a number of letters writ
ten to her by Thaw. In these he paint
ed a glowing picture of her life If she
married him.
Although she had voluntarily left
Thaw, Evelyn Nesblt expected to re
cover a large sum of money from him.
As to the extent of White's Influence
In causing her to take such a course,
there Is said to be positive evidence
that when she returned to New York
she met White at Sherry’s with dem
onstrations of affection and they had
a long and earnet talk.
Qave Her Big Sum.
Following this the affidavit was
drawn up. On Thaw's return from
abroad he was shown tlio affidavit. He
at once capitulated. It la said,'met Eve
lyn Nesblt'a demand for a large sum
of money and also settled the fees of
her lawyers, which were heavy. Short
ly afterward Miss Nesblt went to Eu
rope.
Thaw followed her and they patched
up their differences abrond. Later
Thaw learned that Stanford White
had Instigated the action against him,
according to the story told the district
attorney, and It rankled In his breast
Wjfs May Convict Thaw. .
The statement Is made today that the
district attorney relies upon evidence
of Evelyn Nfcsblt Thaw to convict Har
ry Kendall Thaw of the murder of
Stanford White. The prosecution ex
pects to gain possession of an affida
vit made by Mrs. Thaw In an action
she contemplated bringing against the
young man before her marriage to him.
Thts, It was asserted, wilt be a se
vere blow to the defense, aa It will, It
I. alleged, establish a motive and pre.
meditation.
Stanford White, tt Is said, directed
the drawing up of this affidavit, In
which Miss Nesblt mads serious
charges against. Thaw. Upon seeing a
copy of the affidavit. Thaw settled with
the girl for a handsome sum, the story
goes.
Pittsburger to Aid Thsw..
Shortly after this Evelyn Nesblt went
to Europe. Harry Thaw followed, they
met and made up their differences.
Sellers McKee, president of the First
National bank, of Pittsburg, stated at
the Waldorf that he would gladly con
tribute (50,000 toward a fund for the
defence of Thaw If It ahould be needed.
Mrs White, widow of the slain mail,
who had planned to get away from the
distressing scene and spend an Indefi
nite time In Europe, has Joined with
nichard Mansfield White, the brother.
In an effort to send Thaw to the electric
chair.
Found Nothing Wrong.
The attitude of John D. Lindsay,
president of the Society for the Preven
tion of Cruelty to Children, in an open
letter addressed to Anthony Comstock,
'avs the closest observation failed to
show that young girls were taken to
White'* studio.

Pittsburg, Pa, July 6.—The Hartje
divorce case was renewed today with
the same vigor which has character
ized It since the trial began one week
ago' Tuesday.'
Hartje was early on the scene, but
Tom Madlne, former white coachman,
was there before him. Mrs. Hartje,
the most Interesting of this trio of
principals In the sensational case, was
ast to arrive.
Tom Madlne was called to the stand
as soon as the trial began, Attorney
Marron continuing the cross-examina
tion he began Tuesday afternoon.
Madlne denied getting letters from
Mrs. Hartje.
Madlne testified to- Hartje having
taken a strange tall woman to his own
homo at 10:10 o’clock at night, while
.Mrs. Hartje was away. Tho woman,
Madlne said, was taken Into the car
riage with curtains drawn, at the
Forbes street entrance to Schenley
park.

Chattanooga, Tenn, July 6.—In an
explosion of powder, on the Jasper
branch of the Stevenson extension of
the Southern railway, four workmen
were seriously Injured this morning.
They are J. L. Yandell, a brother of
Yandell Brothers, contractors; J. T.
Allison, foreman; J. L. Tudors, fore
man, and an unknown foreigner: They
were drilling In an excavation. near
Jasper when a load exploded, together
with four cans of powder.
All were badly burned and are In a
serious condition. They were brought
to a local hospital for treatment.

New York, July 5.—Despite the ad
missions of a member of the firm of
Howe & Hummell that the papers In

six months before their marriage were
drawn up by that firm. Judge Olcott
Thaw's counsel, and hi* clients Joined
this afternoon In Iin emphatic denial
that any such action wax ever taken.
In his statomsnt on behalf of Harry
and Evelyn Nesblt Thaw, Judge Ol

absolutely without foundation. He said
that both Thaw and his wife had as
sured him that no such action ever was
taken or contemplated by Mrs. Thaw
and that there had never been grounds
for .such a suit. , '

As to the affidavit of Evelyn Nes
blt Thnw, which waa said to have been
a partof the suit. Judge Olcott de
nied that It ever existed.
After a talk with Mr. and Mrs. Thaw
at the Tombs, Judgt Olcott said:
"The story as published In regard
to Mrs. Thsw at one time contemplat
ing an action for breach of promise
against Harry Thaw Is absolutely mn-
true. You may quote Harry Thaw to
that e:ect aa well aa Mrs. Thaw, who
has denied such a story to me.”
"1 have had a long talk with my
client and he tells me, as Mrs. Thaw
also has told me. that there Is not the
slightest basis for the story. I defy
any one to come forward and prove to
the contrary. It Is quite evident that
this story was Inspired originally by
the enemy."
“Mrs. Thaw tells me that at no time
had she such an action In mind and
certainly that the never went to any
lawyer's office to accomplish such a
purpose. The story Is made out of

six persons, four women, a girl of

recovered today from tho waters of
Lake Manawa, where last night more

of a girl was recovered last night

slaughtering «fittlo which art 1 not fit
for human food; that Atlanta meat
dealers are dally Belling meat from aucli
animals to housekeepers throughout the
city; that Atlanta citizens are dally
eating meats which would be condemn
ed by an Inspector who carried out tho
lairs of the city. Is the statement made
by members of the county police.
That thero Is anything new In such a
statement Is laughed at by the officers,
who say that It has been going on for
years. The casual discovery of one In
stance and a disruption of the recent
Investigations In Chicago following the
disclosures made in "The Jungle"
brought out the facts.
Last Tuesday aftomoon Officer Dun
bar, of the county police, was asked by
a woman living on the Marietta rood to
assist her In finding a cow which had
strayed. The search took the officer
Into a small slaughter house about
throe miles from the city, where he
failed to find tho cow he wantod, but
found other things.
"They hud Just slaughtered one cow,'
said Officer Dunbar In answer to quos
tians, "which would have given birth to
a calf within a very short time. The
body of tho calf was taken from Its
mother and I cannot say what was done
with It. I have no reason to doubt that
tho beef of the cow was sold to butch
ers, as I know that this Is done every
day and hatf been done for years.
"Thts occurred at n small slaughter
houso near tho Marietta road, about
three mllos from tho city. The place Is
used by a man named Bunletto or Bur-
dett. 1 do not know his first namo. He

meat dealers In Atlanta."

condition described by the officer Is
unfit for food and Its sale Is forbidden

A. O. Bacon, by whom he Is employed,
this morning had his attention attract
ed by a buzzard (lying from a deep
ravine In the woods. Leaving his plow
In the field, he went to the scene and
found there the corpee of a dead man,
whose bones had almost been picked
bare by the buzzard. A letter nnd a
Panama hat were lying near by, by
which the body was Identified as that
of IL C. Dews, the missing manager of
the Moron Phonograph Company,
whose continued absence since June 28
has been a mystery. The body had
