here by way of Lisbon that a des
perate battle has been fought be
tween government troops and
rebels in the Brazilian state of
.Mattogrosso. The battle was still
raging when tho news was sent
and 4.000 men were reported kill
ed. The government troops, un
der General Ricberio, attacked
the rebels who had captured sev
eral cities.

the Lyerly murder case, and, a mob is
threatening to storm the jail at Salis
bury, where the suspects are incar
cerated. There may be serious develop
ments.
Charlotte, N. C., July 14.—Rushing
down stairs about I o'clock this morn
ing, the two daughters Of Iaaac Lyerly,
a prosperous planter and storekeeper,
of Barber Junction, were horrified to
see the bodies of their parents and
three small children scattered about
the room, with blood nosing from their
heads.-where they had Wen stricken
with a blunt Instrument.
The girls screamed and help was not
alow In coming. .
The sheriff with doga came In on
special train and a posse Is now In
pursuit. »
The murders were committed by bur
glars, It la believed, who were after
Lyerly'a money.
Negroes Under Suspicion.
Two negroes, recently discharged,
are under suspicion. Already the gov
ernor has offered 2850 reward for the
criminals. The most Intense excite
ment prevails.

It was Mre. Shlppo who ewore that
Mrs. Klnan, aa the lay dying, gasped:
"That devil lawyer did It." The attor
ney alleges that Mrs. Shlppo demanded

Meanwhile the Inquest has been sd-

Mr. Olbson will be the first witness
called to testify. Hs has summoned

victed yesterday of the murder of Sam-
net Goldberg, a saloon-keeper, three
months ago, and sentenced to life Im
prisonment, was found dead In his cell

to cheat the cell In case he should be
sentenced to life Imprisonment. He

New York. July 14.—"Joe" Lelter,
the millionaire mine owner of Chicago,
waa sought today as a witness In the
Thaw, case by the district attorney's
office, It wae learned, aa a result of
revelations made to Assistant District
Attorney Garvap by actresses he has
questioned.
According to the Information which
has come to tie district attorney's of
fice. It wae said that Lelter was want
ed to tell of certain Incidents which
occurred In New York, at n-bteh both
Harry I{. .Thnvv- and Evelyn Neablt
Thaw were present.
A Little Dinner Dance.
This Information was concerned
chiefly with a little dinner dance, at
which- Nina Farrington, the actress,
was the guest of honor. Bancroft Da
vis, a well-known club man, was also
a guest. It Is stated.
The sensational Incident of which
“Joe" Lelter Is expected to tell Is to
the effect that Davla knocked Thaw
down during a quarrel over an alleged
attempt on the. part of Thaw to cauae
the dancing party to degenerate Into
one of those boisterous affairs for
which Thaw was famous among his
friends.
Horsewhipped sn Actress.
Another Important' witness secured
by the district attorney's office Is Miss
Ethel Thomas, also sn actress, who
has testified, It is said, to the fact that
Harry Thaw horsewhipped her at ono
time out of mere exuberance of spirits.
Mies Thomas brought an action for
120,000 against Thaw for the alleged
horsewhipping, but although tho suit
had been on record for four years It
had been kept so far down on the cal
endar that It never hod been "bro
to trial. A singular coincidence Is
Abraham T. Hummel la attorney of
record In this suit. He was the lawyer
who figured In tho much-dlscuased af
fidavit alleged to havo been signed
by Evelyn Nesblt at the Instigation of
White.

suit the district attorney was consulted
regarding a criminal action.

Just think! You can't buy a soft drink within a mile of Young Har
ris College In Young Harris county, If this bill, Introduced by Mr. Corn,
of Towns county, which passed house Saturday morning, also passes
the senate.
This bill says:
It shall be a misdemeanor to sell or givs away, Indirectly or directly,
any hot or cold drink, within a mile of Young Harris College. In Towns
county. Bottled drinks and those which are generally sold "nut of or
from" soda fountains are barred, as are any made from "Juices or mix-
1 turea.” The latter two take Into consideration that there Is no pure food
law NoMong ago, the parents of a student at Young Harris complained of
the bill sent In by a young son for "Incidentals." On'lnvestlgatlon It was
found to be for many, many drinks, milk shakes, chocolate milks, and
everything else. The father made a kick,.and how comes the result.
The bill stated expressly that It was for the purpose of saving the
parents of Young Harris students much expense, caused by the Inevitable
soda water thirst of the school boy. ... V

Birmingham, Ala.. July 14.—Premedi
tated aulclde le the verdict of Coroner
Parle, after making an Inveetlgatlon of
the death of Jerry Fountain, a native
if Georgia, who swallowed almoat the
entire contents of a bottle of morphine
in ths presence of his wife, from whom
hs waa divorced, and washed the drug
down with a pint of beer. Not satis
fied with the first teaipoonful, hs took
second doee, which he ewallowed
with m|lk. Placing the arm of hla
wife about hla neck, he eald hi was
ready to die. From that time until tho
end came a few minutes before mid
night last night he was unconscious
nnd never uttered another word. Com
ing here with hie parents about twenty
years ago from Macon, (la.. Mr. Foun
tain taught school for. a number of
years and st one time was county su
perintendent of education. He was
chief deputy eherlff at Bessemer up to
November, 100ft, when ht resigned to
become atato president of the Fraternal
Order of naglos.
Failure to effect a reconciliation with
his wife Is thought to have caused the
deed.
