BY MILLIONAIRE BOY AND MO THER
The New York Sun of Friday aaya:
Frank Daniels, sometimes a comedian
and at other times the village cutup of
Rye, N. Y., got real gay at Wallaek’s
theater last night at the performance
of th*» show, "His Honor tha Mayor.**
Daniels was seated In a box at the
right hand of the stage. With hltn
were Colonel Elvcrson, n Philadelphia
newapaper proprietor, and several other
friends.
Miss Nella Webb was singing her
song, “Wouldn't You Like to Have a
Little Girl Like Me?" There Is a re
frain to this rcng that ha- much con
cerning kissing. Each night there is
a '•stair In the orchestra seats who
t:ets real nervous when the spot light
Is thrown on him and Miss Webb sings
lots of nice things to him.
While this stunt was on last night
Miss Webb tripped over close to the
box containing Daniels and his friends,
puckered up her lips and sang toward
the comedian. Everybody In the house
t laughed, hut Daniels dldnt get nerv
| ous. He Just waited until the actress
got sufficiently near. Then he grab-
I Bed her by the m se and held on until
he climbed over the front of the box
and on the stage. After planting about
u doxen kisses Daniels crawled back
Into his box/
All this served to cause Hie ajdl-
ence to rise to their feet and howl.
Miss Webb wns so flustered that aha
couldn't sing the rest of the song.
Uian^he HIng. who had been a wit
ness to the proceeding, looked at Dan
lels repiouchfully and said:
"Oh, Frank! Ilow could you?"
Three men who sat In the front row
of the orchestra seemed to approva of
Frank Daniels' act. One of them, who
looked and talked like a Sbuthemer,
led the way, and the three Jumped Into
the orchestra and then climbed up on
the stage. Th* Southern-looking man
got a few kisses before the stage
manager concluded maters had gone
far enough and rang down the cur
tain. After a brief Interval the show
went on.

A temporary restraining order w„
Issued by Judge George F. Gober. of
the Blue.Rldge circuit, who Is prelud
ing during the aheene* of Judge Pen-
Jleton, Saturday morning, to prevent
the Louisville and Nashville railroad,
the Ferro-Concrete and Construction
Company, the city of Atlanta and the
Georgia Railway and Electric Company
from taking possession of Waverly
plnce, near Washington street, und
from blockading the free passage and
use of said street; from removing ,,r
placing railroad tracks and In any
manner Interfering with the said street
until a hearing can be held upon the
case tty Judge Pendleton In the supe
rior court on September I. The re-
straining order was Issued as the result
of a petition to the effect filed by Ger-
ehon Brothers’ Company.
The Gerehon Company occupies a
three-story brick, building on Raverly
Ipluce, close to Washington atreet. with
a lease- which docs not expire for two
years. A few weeks ago the Louisville
and Nashville began the construction
of a warehouse on the street and the
city voted to construct a viaduct us un
extension of Washington street. The
cltjr council voted to close Waverly
place on condition that the railroad
company grant a deed of land close hy
for a new Waverly place. The peti
tioners claim that In order to obtain the
consent of the mayor and the city
council to make such change, the rail
way company falsely and fraudulently
represented to the mayor and counsel
that It was the sole owner and In pos
session of all property abutting on
Waverly place.
The petitioners further allege that
the new Waverly place has not been
deeded to the city, sidewalks have not
been graded, no curbing laid down,
sidewalks laid out or the street paved,
as ordered by the c/y council. The
Georgia Railway nnd Electric Company
Is tearing up Its tracks through the old
Waverly place and the Louisville ami
Nashville Company, through the Ferro

laying Its own tracks thereon.
The petitioners prnjr that defendants
be restrained from taking possession
of the old Waverly place and from
blockading the free passage and use
of same; the Georgia Electric Rallwuv
Company be enjoined from removing
Its tracks, wires and poles and front
