Sims will be compensated for the lose of life passes on the Northeastern Railroad, now a port of the Southern system. There Is some Interesting history back of this case. In 1571 the North eastern was built connecting Athens and Lula. The state took over the bonds of the road, thus coming Into practical possession of the property. Sherman Sims gave the land for the Maysvtlle depot and about halt a mile of the right of way. In all some 12 acres of land. In consideration for this rrant Governor Atkinson Issued lifetime |>asaes to eleven members of Sims’ family. During Governor Candler's adminis tration the Northeastern was sold to the Southern, and that company de clined thereafter to honor the passes offered by any of the Sims heirs. The Southern held that Its purchase did not contemplate carrying out the private agreement of the state as regards the passes. Since that time persistent efforts have been made to secure from the state some compensation for the loss of the posses. A - resolution introduced iu the general assembly once failed, but last session a resolution was pass ed appointing a committee to go ' to Maysvllle and look Into the matter. That committee found that the Sims' heirs were entitled to some compensa tion. The claim will probably be ad justed on the basis of the valuation of concerned. H. H. Dean, of Gall J. B. Mehafty and W. O. Tike, of Jef ferson, are In'Atlanta representing the heirs In the effort at a settlement. Governor Terrell has passed the case to Attorney General Hart for his Interpretation of "Just compensation for the lose of lifetime passes. 1 As Judge Hart Is engaged In the United States clrctfll court he will not be able to render an opinion before Thursday afternoon.
