Hunter St. STATE TO SETTLE WITH S1/14S HEIRS FOR LOSS OF PASSES An agreement will probably be reached nome time Thursday afternoon whereby the eleven heir* of Sherman J. Sims will be compensated for tile loaa of Ilf# paaaea on the Northeastern Railroad, now a part of the Southern system. There la some Interest In* history back of this case. In 1878 the North eastern was built connecting Athens and Lula. The state took over the bonds of the road, thus comine Into practical possession of the property. Sherman Sims gave the land for the Maysvtlle depot and about half a mile of the right of way. In all some 12 acres of land. In consideration for tills, grant Governor Atkinson Issued lifetime passes to eleven members of 81ms’ family. During Governor Candler's adminis tration the Northeastern was sold to tho Southern, and that company de-, cllned thereafter to honor the. posses offered by any of the Sima heirs. The Southern held that Its purchase did not contemplate carrying out" the private agreement of the state as regards the passes. Since that time persistent efforts have been made to secure from the state some compensation for the loss of the passes. A resolution Introduced In the general assembly once failed, but last session a resolution was pass ed appointing a committee to go to Maysville and look into the matter. That committee found that the Sims' heirs were entitled to some compensa tion, The claim will probably he ad justed on the basis of the valuation of the lifetime pasHes of the eleven people concerned, it. H. Dean, of Gainesville, J. B. Mehaffy and W. G. Pike, of Jef ferson, are In Atlanta representing the heirs In the effort at a settlement. Governor Terrell has passed the case to Attorney Geperal Hart for Ills Interpretation or "Just compensation for the loss of lifetime passes." As Judge Hart Is engaged In the United States circuit court he will not Ijc able to render an opinion before Thursday afternoon. The twelve acres donated by Sherman Sims Is now val ued at $8,009.
