charge of using the mail* to defraud,
two Indictments have been returned
by the Federal grand Jury against
Philander H. Fitzgerald, a wealthy pen-
, slon attorney.
Both Indictments are In connection
with a colonising scheme In Georgia.
Fitzgerald Is generally regarded es a
millionaire. He is the publisher of The
American Tribune, an old soldier pa
per, and Is. a real estate dealer, He
Is Interested In colony plans.
Ha Gives $4,000 Bond.
After hearing of the Indictments lie
went to the Federal court building and
gave $4,000 bond.
He says the. Indictments are the re
sult of spite work.
It Is alleged that Fitzgerald did not
Incorporate the 8t. George (Oa.) t'olony
Company; that he got In about $70,000
on his scheme and spent about $33,000
In plotting the town, building a post-
office and making cither Improvements:
tlmt he has not divided the surplus, as
he promised; Hint he did not appoint

Greensboro, X. C\. Nov. 33.—Minnie
Osborne, a white women, and John
Wood, a negro man, were jailed here
here this morning, charged with burn
ing {ho barn, of Newton Leonard, on
Wednesday night. In which was de
stroyed four horses, nine cows nnd a lot
of farm machinery.
Leonard and family were asleep and
knew nothing of the burning until next
morning.

low the pension oillces to be moved
the rooms he now occupies. If this sug
gestion Is carried out by the governor
the new Judges will have very com
fortable offices. This matter, however,
has not been decided as Jet.
