lo the charge* made by Attorney Gen
eral Davidson b> the effect that Sena
tor Joe Bailey received money from
the Waters-Plerce and Standard Oil

Pierce, of the former company, for se-

Pierce concern In the Texas Held, after
it had been ouated under the anti-trust
laws, Senator Bailey haa given out a
lengthy statement.
He admits receiving about 315,000
from President Pierce, of the Wnters-
I’ierce Company, but aaya it was In the
nature of a loan, and that ho returned

other eume of money from Mr. Pierce,
one a loan of 58,000. This, he asserts,
visa also paid back.
Couldn’t Find Note.
When he went to pay the loan Sena-
tor Bailey eaye Mr. Pierce was never

arknowledgment in writing and he now

Regarding the uttornoy general’s re
fusal to furnish him with all the

“I had hoped that you did not wish
to descend from the exalted position
which you hold to engage In a political
warfare against me, and believed that
you would afford me an opportunity to
examine papers supposed to he In your
possession, which I had denounced as
forgeries nt a time when every effort of
unscrupulous nnd designing enemies Is
being concentrated to blacken my char
acter nnd reputation.
"If It be your purpose to use the
power of your official position In an
effort to destroy ine by the use of pa
lters which I know to be forgeries; if
they reflect, what I am Informed
through your (itiestlons, the public
prints and otherwise they purport to
reflect, then, ns a manly man. you
should meet the Issue equarely and no
longer prate about being filled with
elmine and sorrow concerning the ex
istence of papers which I denounce to
bo spurious, and which you refuse to
let me see.”

Atlantn-BIrmlngham Insurance Com
pany has been begun. Deputy Insur
ance Commissioner A. C. Sexton, of
Alnbama, who was agpolnted tempora

the purpose of looking Into the matter.

private physician to, the pope, died this
morning.
Dr. Lapponl had suffered from can
cer of the stomach for a long time, and
physicians called Into consultations re
cently advised an operation.
Dr. Lapponl was Pope Leo’s physi
cian nnd attended the pontiff In his
last Illness. When Pope Pius came
to tho Vatican Dr. Lapponl was his
modlcal adviser.

Lincoln, Nebr., Dec. 7.—Commenting
on President Roosevelt’s message, W. J.
Bryan saya there la much that !■ good
and much that in bod In ft. but It may
be regarded ait the president's most Im
portant state paper. He deplores the
president's so-called war-llke attitude
in his references to the army und' navy.
Mr. Bryan says:
"The message contains much that Is
Democratic and for which the general
public may well thank him. The pres
ident boldly adopts some of the oloc-
trlnrs which the Democrats have been
advocating, anil on the other hand he
announces some doctrines which are so
absurd as to excite amusement If the
uggestlons came from a less promi
nent source.
In come cases he takes advanced
ground; In soma cases he retreats from
ground already taken. He pays a de
served tribute to the progress of the
Japanese nation and asks for legisla
tion which will enablo congress to pro
tect the treaty rights of foreigners.
That there should Ite such legislation
cannot be denied, but a great deal de-
lieuds upon the character of the legis
lation. Bills In regard to thls~must
be carefully scrutinized to be sure they
do not deny to the vnriobs states tfte
rights to protect themselves and their
people In matters purely local.
"There will be disappointment at the
war-ltkc tone of his tgessage where he
discusses the army and the navy. He
speaks of the navy as the surest guar,
antor of peace which the country pos
sesses; It Is regrettable that he should
place an agency of brute force over
the nation's sense of Justice as a guar,
antor of peace."

tition In the superior court Thursday
asking an Injunction against the Na
tional Master Plumbers’ Union and the
General Supply Company of Atlanta.
The petitioners are members of the
Arm known ns the Marietta Plumbing
Company and declare that because they
are negroes the National Master
Plumbers' Union has refused to admit
them Into membership and that no or
