A pathetic, appeal has hnen made to
spare the lives of these young fellows,
based on the fart, In part, th^t the law
haa been satisfied by the execution of
Rawlins, Sr., and the negro, Alf Moore.
It Is not the appeal Itself, but tho
ground of the appeal that I am hero
concerned with, that the law has been
satisfied. It Is not the Intention of this
brief paper to dlsouss the commutation,
but to point out that the case haa been
discussed largely on a: false theory of
punishment, vlx., that there Is some
huge tyrant, called the Law, who must
be satisfied. Or, that the lower to be
satisfied Is the dear people. The mass.
es having been satisfied by tho execu
tion of the two most responsible char
acters, experience a revulsion of feeling
nnd are willing, some of them, to have
the Rawlins boys sent to the peni
tentiary for life, some to have them
pardoned altogether.
Now whatever may lie the wisest
to deal with any particular case, It Is
worth while to try to get a clear view
of the guiding principles.
There Is, It has been stated, a new
science of penology. The fundamental
difference, the line of cleavage between
the new nnd the old. In dealing with
crlmo and criminals. Is that whereas
the old dealt with the crime os an ab
stract entity, and on the principle that
so mueh crime of a certain character
culled fur so much punishment of a
certntn character; the new deals pri
marily with the criminal hlmseir, and
with tho crime ns revealing the char
acter of the criminal. And In dealing
wlllt the criminal the motive and
method are different. Th6 atm Is not
punishment to satisfy an abstract law
of desert; the aim Is rather the re
demption, the reformation, the saving
of the man, the criminal himself, from
his crime. If a man has committed
murder, the object of society In deal
ing with the ninn should be, both the
j protection of society from similar men
nnd also the training of such man into
a helper instead of a murderer of his
fellows.
The <|ueslion ought to be asked. In
I iegard to the Rawlins boys, not wheth
er the law has been satisfied, nor
whether public sentiment has been ap
peased, hut what Is th» best thing pos
sible, society being what It Is, for the
boys themselves? How may we deal
with them so as to suve them from
I the mnllcc and Ignorance that led to
the commission of so foul a deed?
NhouM they be hanged? Should they
be sent to the penitentiary for life?
One thing seems certain, and If It does
not solve of Itself the whole problem.
It Illuminates some aspects of It, nnd
It is simplicity Itself, so simple that It
I hardly seems to have occui led to'
| many: If those boys ought to he par- ’
mined, there Is one only justification;
for such a course, vis., the conviction
arrived at by the vety best expert I
opinion procurable, that In freedom j
they would best develop the character
of good ritlxens, and not abuse their:
'Iberty. It may be that n reasonable
I conviction on this point cannot be ar- |
rived nt all at once. Very good, then, i
we ran wait until It ran be arrived at,
In the meantime subjecting them to the
best discipline our civilisation .affords.!
Ought those boys to lie hanged? Jaj

That must depend on our civilisation,
ami Is not a question that can he
answered categorically. It m.iy be that
some cases are beyond the power of
human society. In Its present state, to
deal with In any more satisfactory way,
just as a school may have to expel a
boy; but In both cases, the Ideal ought
to be, to save bo tlx, to save the mur
derer from his malice and the boy from
his disobedient spirit.

stood. It alms at the highest good, not
the pleasure of Its object; and It does
not hesitate to use severe methods In

mental method of dealing with the
blind beggar on the street, but aimed
at his reformation by means that did
not commend themselves either to tho
blind man himself, or other sentlmt

to execute a man; It certainly would
not hesitate to hold him In prison; It
certainly would not give him knowingly
a liberty he was certain to abuse.
Nor Is there any conflict, as Is com
monly supposed, between the two points
of view, the good of society tby the
prevention of crime) and the good of
the criminal. To suppose that there Is,
takes for granted an Irreconcilability
between the corporate and tho individ
ual welfare that Is fallacious.
If society were to become so sat
urated with the redeeming principle
of love that Its whole penology ex
pressed the spirit of relentless seek
ing the good of the criminal, much of
the rebellious spirit that now animates
the criminal classes (tho “enemies of
society"), would gradually dlsnpiiear

the working of tha law of overcoming
evil with good.

Washington, Dec. 8.—Because the
railway authorities are not yet satis-
fled that sufllclcnt Information has been
received to fix the blame for tho wreck
on tho Southern railway, in which
President Hpencer lost his life, more
witnesses have been summoned here,
and they will reach here on Monday.
On the same day all tho employees of
the road who have been hero testifying
will go to Richmond to attend the hear
ings before the state corporation com
mission. Mattox and Jacobs returned
to their homes last night and will go to
Richmond this afternoon.
Tim examination of the new wit
nesses will occupy ii day or two, and
the rjMlroad officials will not have their
report ready before Wednesday.
All the employer* of the routl. espe
cially those of the Danville division, are
eager to have the fullest Investigation,
and want the blamo for the wreck
fixed on the right person or persona.
Mattox and W. H. Glimmer, tho two
operators at Rangoon, who were in the
signal tower at the time of the wreck,
are anxious to make a statement, but
decline to do so until the report of tho
Investigation has been mado public.
