V It is understood that, in the course of their consultation, tho Judges were of the epinion that it td.uitted of a great deal of doubt with the clause of sac tun 5 of art. 3 uf the Cocstituiion, prohibiting the pas sage ofany awisaneiioningin any manner, directly or ind reclly, the suspension of specie payments by any person, association or corporation issuing bank no es of any description, applies to any liability of such an association or corporation other Pan bank bills or notes, win h an by statute to circulate as money, nnd for the payment of which the faith <t the State is now pledg ed. • Since the shore was writtrn, we have r ceived the fo lairing official report of the meting: 1. In all cases in which the act of 1849 is applicable, i; is deemed to supersede the S hrvisions of tie Revised Statutes. (2 R 46t sec 47.) Accordingly no creditor of the Bank who may have relief under that act can have it under the Revised Statutes That act gives the creditor the right to ap ply to a Justice of the Supreme C.urt.only after the expiration often days from the refusal of the Bank to pay its debts or lia bilities. •2 Even then a temporary and immedt- ate injunction can be granted only if, in the opinion of the Judges, it be expedient in order to prevent fraud or injusttee. After both parties shall be heard before the Judge he ;S to determine whether the bank is clear ly insolvent or no'. ' 3. A bank i* clearly solvent which is clearly able to par all it: debts although it may have suspended ipeeie paymente for a time.
