John Trowbridge. ) UPON the petition of John YY’hitehead, James YV hitehead and Samuel Dowse, alleging that on the thirtieth day of November eighteen hun dred and forty , John Trowbridge executed to them his certain mortgage deed whereby to indemnify and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on the 28»h day of August, A. D. eighteen hundred and forty-live, each for the sum of eight hundred dollars, the one payable twelve months and the other two years after date, signed by said petitioners as securities, he conveyed to said petitioners cirtain tracts or parcels of land i lying and being h said county of Richmond, the one being in the mighbnrhood known as Richmond Bath, containing tvelve acres more or less, hound ed north by lands of James Whuehead, west by lands of Joshua Kiv, and south and south east by the Bath tract. And the said petitioners further alleging that the said John Tfowbridge has failed and neglected to pay said n«es and has become insolvent, and that they the said petitioners have paid them and that there is now 4ue them on said notes the sum of eighteen hundred and forty dollars and fifteen cents and praying that the equity of redemption in and to said mortgaged property may forever be foreclosed. It is ordered that the said John Trowbridge pay ia to Court on or before the first day of the next term, the principal and interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not he forever barred and foreclosed against him; and further, that a copy of this Rule be published in one of the Gazettes of the City of Augusta once a m.unth for four months - r served on the said John Trowbridge or his special agent or attorney, and al lowing three months before the first day of the next term.
