day in the month, between the hours often m the fore
noon and throe in the afternoon, at the Court House in
which the property is situate. Notice of those sales
must be given in a public Gazette SIXTY DAY S pre
vious to the day of sale,
tales of NEGROES must be at Public Auction, on the
first Tuesday of the month, between the usual hours o
sale, at the place of public sales in the county where
the Letters Testamentary, or Administration, or Guar
dianship, may have been granted, first giving SIXTY'
DAY’S notice thereof, in one of the public Gazettes o
this State, and at the door of the Court House \\ here
such sales are to be held.
Notice for the sale of Personal Property must be given
in like manner FORTY DAYS previous to day of sale
Notice to the Debtors and Creditors of an Estate must be
published for FORTY DAYS.
Notice that application will be made to the Court of Or
dinary for leave to sell LAND, must be published fur
FOUR MONTHS.
Notice for leave to sell NEGROES, must be published
FOUR MONTHS, before any order absolute can eb
given by the Court.

XTPON the petition of J&hn Whitehead, James
J AA'hitehead and Samuel Dowse, alleging that
on the thirtieth day of November eighteen hun
dred and forty. John Trowbridge executed to them
his certain mortgage deed whereby to indemnify
and save harmless said petitioners, conveying two
certain notes, made by said Trowbridge to Isaac
Bryan, dated on tiie 28ih day of August, A. D.
eighteen hundred and forty-five, each for the sum
of eight hundred dollars, the one payable twelve
months and the other two years after date, signed
by said petitioners as securities, be conveyed to
said petitioners certain tracts or parcels of land
lying and being in said county of Richmond, the
one being in the neighborhood known as Richmond
Bath, containing twelve acres more or less, bound
ed north by lands of James AVhiteboad, west by
lands of Joshua Key, and south and southeast by
the Bath tract.
Also, two tracts conveyed by said John Trow
bridge by Isaac Bryan and described as f< Hows, to
wit: u AH those two tracts or parcels of land situ
ate, lying and being in the county of Richmond and
State of Georgia, one containing twelve hundred
acres, more or less,on Spirit Creek, bounded north
by lands of John Cashin, deceased, east by lands of
Absolom Rhodes, composed of two tracts, one of!
one thousand acres, granted to James Beall, and
another of two hundred acres granted to James
McManns.
Also, all that other tract or parcel of land, situ
ate in same county and State, containing fourteen
hundred and nearly two and three quarter acres,
more or less, together with 3lills and improvements
thereon, and bounded east by lands, lately own
ed by the estate of Lowe, west by lands now
nr lately owned by Forkerbery, south by lands
bcught by one John Cashin, Senior, now deceased,
oorth by lands belonging to Absolom Rhodes. And
the said petitioners further alleging that the said
John Trowbridge has failed aad neglected to pay
said notes and has become insolvent, and that they
the said petitioners have paid them and that there
is now due them on said notes the sum of eighteen
hundred and forty dollars and fifteen cents, and
praying that the equity of redemption in and to
said mortgaged property may forever be foreclosed.
It is ordered that the said John Trowbridge
pay in to Court on or before the first day of the
next term,the principal and interest due on said
' mortgage, or shew cause why the Equity of Re
-1 demption unto said mortgaged premises should not
’ be forever barred and foreclosed against him; and
further, that a copy of this Rule be published in one
of the Gazettes of the City of Augusta, onge a
month for four months '»r served on the said John
Trowbridge or his special agent or attorney, and al
