Janies J Whitehead and Samuel Dowse, alleging that on the thirtieth day of November eighteen hun dred and forty', John Trowbridge executed to them his certain mortgage deed whereby to indemnify and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on the 28lh day of August, A. I), eighteen hundred and forty -live, each for the sum of eight hundred dollars, the one pay able twelve months and the other two years after date,signed by said petitioners as securities, be conveyeff to said petitioners certain tracts or parcels ot land lying and being in said county of Richmond, the one being in the neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of James Whitehead, west by lands of Joshua Key, and south and south <B;»st by the Bath tract. Also, two tracts conveyed by' said John Trow bridge by Isaac Bryan and described as ft Hows, to wit: ‘Ail those two tracts or parcels of land situ ate, lying and being in the county of Richmond and .State of Georgia, one containing twelve hundred acres, more or less,on Spirit Creek, bounded north by lands of John Casbin, deceased, east by lands of Absolom Rhodes, composed of two tracts, one of one thousand acres, granted to J; mes Beall, and another of two hundred acres granted to James McManus. Also, all that other tract or parcel of land, situ ate iu same county and State, containing fourteen hundred and nearly' two rfnd three quarter acres, more or less, together with Mills and improvements thcreojj, and bounded east by lands, lately own ed by the estate of Lowe, west by lands now nr lately' owned by Forkcrbcry, south by lands hr nght by one John Casbin, Senior, now deceased, oorih by lands belonging to Absolom Rhodes. And the said petitioners further alleging that the said John Trowbridge has failed and neglected to pay said notes and has become insolvent, and that they the said petitioners have paid them and that there is now due them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property may forever be foreclosed. It s ordered that the said John Trowbridge pay in to Court on or before the first day of the next term, the principal and interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not be forever barred and foreclosed against him; and further, that a copy of this Rule be published in one of the Gazettes of the City' of Augusta, once a month for four mouths or served on the said John Trowbridge or his special agent or attorney, and al lowing three months before the first day of the next term.
