D. eighteen hundred and forty-five, each for the sum of eight hundred dollars, the one payable twelve months and the other two years after date,signed, by said petitioners as securities, he conveyed to ’ said petitioners certain tracts or parcels of land lying and being in said county of Richmond, the one belngini the neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of James Whitehead, west by lands of Joshua Key, and south and southeast by the Bath tract. Also, two tracts conveyed by said John Trow bridge by Isaac Bryan and described as fi Mows, to wit: “AM those two tracts or parcels of land situ ate, lying and beilig in the count}' of Richmond and State of Georgia, one containing twelve hundred acres, more or less, on Spirit Creek, bounded north by lands of John Cashin, deceased, east by lands of Absolom Rhodes, composed of two tracts, one of one thousand acres, granted to Ji mes Beall, and another of two hundred acres granted to James McManns. Also, all that other tract or parcel cf land, situ ate in same county and State, containing fourteen hundred and nearly' two and three quarter acres, more or less, together with Mills ami improvements thereon, and bounded east by lands, lately own ed by the estate of Lowe, west by lands now nr lately owned by Forkerbery, south by lands bfught by one John Cashin, Senior, now deceased, - oor:h by lands belonging to Absolom Rhodes. And the said petitioners further alleging that the said John Trowbridge has failed and neglected to pay’ said notes and has become insolvent, and that they the said petitioners have paid them and that there is now due them on said notes the sum of eighteen hundred and forty dollars and fifteen cents, and pratring that the equity of redemption in and to said mortgaged property may forever be foreclosed. It is ordered that the said John Trowbridge pay in to Court on or before the first day of the next term,the principal and interest due on said mortgage, or shew cause why the Equity of Re demption unto said mortgaged premises should not be forever barred and foreclosed against 1 im; and further, that a copy of this Rule be published in one of the Gazettes of the City of Augusta, once a month for four months or served on the said John i Trowbridge or his special agent or attorney, and al lowing three months before the first day of the next term.
