UPON the petition of John Whitehead. James <
Whitehead ana Samuel Dowse, alleging that I
on the thirtieth day of November eighteen hun
dred and forty, John Trowbridge executed to them (
his certain mortgage deed whereby to indemnify i
and save harmless said petitioners, conveying two
certain notes, made by said Trowbridge to Isaac i
Bryan, dated on the 28 s h day of August, A. D. ,
eighteen hundred and forty-five, each for the sum
of eight hundred dollars, the one payable twelve i
months and the other two years after date,signed
by said petitioners as securities, he conveyed to
said petitioners certain tracts or parcels ot land
lying pid being in said county of Richmond, the
one beingin the neighborhood known as Richmond
Bath, containing twelve acres more or less, bound- 1
ed north by lands of James Whitehead, west by 1
lands of Joshua Key, and south and southeast by
the Bath tract.
Also, two tracts conveyed by said John Trow- 1
bridge by Isaac Bryan and described as f Hows, to
wit: “All those two tracts or parcels of land situ
ate, lying and being in the county of Richmond and 1
State of Georgia, one containing twelve hundred
acres, more or less, on Spirit Creek, bounded north ’
by lands of John Casliin, deceased, east by lands of
Absolom Rhodes, composed of two tracts, one of
one thousand acres, granted to J mes Beall, and
another of two hundred acres granted to James
MeManns. i
Also, all that other tract r>r parcel of land situ- (
ate in same county and State, containing fourteen
hundred and nearly tw r o and three quarter acres, i
more or less, together with Mills and improvements !
thereon, and bounded east by lands, lately own- •
e i by the estate of Lowe, west by lands now ,
nr lately owned by Forkerbery, south by lands <
b light by one John Cashin, Senior, now deceased,
oorh by lands belonging to Absolom Rhodes. And
the said petitioners further alleging that the said
John Trowbridge has failed and neglected to pay
said notes and has become insolvent, and that they
the said petitioners have paid them and that there
is now due them on said notes the sum of eighteen
hundred find forty dollars and fifteen cents, and
praying that the equity of redemption in and to
said mortgaged property may forever be foreclosed. 1
It is ordered that the said John Trowbridge
pay in to Gpurt on or before the first day of the
next term,the principal and interest due on said
mortgage, or shew cause why the Equity of Re
demption unto said mortgaged premises should not
be forever barred and foreclosed against him; and
further, that a copy of this Rule be published in one
of the Gazettes of the City of Augusta, once a
month lor four months **r served on the said John
Trowbridge or bis special agent or attorney, and al
lowing three mouths before the first day of the
next term.
