UPON the petition of John Whitehead, James
\\ bite he ad and Samuel Dowse, alleging that
on the thirtieth day of November eighteen hun
dred and forty, John Trowbridge executed to them
his certain mortgage deed whereby to indemnify
and save harmless said petitioners, conveying two
certain notes, made by said Trowbridge to Isaac
Bryan, dated on the 28*h day of August, A. I),
eighteen hundred and forty-five, each for the sum
of eight hundred dollars, the one payable twelve
months and the other two years after date, signed
by said petitioners as securities, he conveyed to
said petitioners certain tracts or parcels ol land
lying and being in said county of Richmond, the
one beingin the neighborhood known as Richmond
Bath, containing twelve acres more or less, bound
ed north by lands of James Whitehead, west bv
lands of Joshua Key, and south and southeast Ly
the Bath tract.
AKo, two tracts conveyed by said John Trow
bridge by Isaac Bryan and described as f Hows, to
wit: “All those two tracts or parcels of land situ
ate, lying and being in the county of Richmond and
State of Georgia, one containing twelve hundred
acres, more or less, on Spirit Creek, bounded north
by lauds of John Cashin, deceased, east by lands of
Absolom Rhodes, composed of two tracts, one of
one thousand acres, granted to J mes Beall, and
another of two hundred acres granted to James
McManns.
Also, all that other tract or parcel of land situ
ate in same county and State, containing fourteen
hundred and nearly* twf) and three quarter acres,
more or less, together with Mills and improvements
thereon, and bounded east by lands, lately own
ed by the estate of Lowe, west by lands now
nr lately owned by* Forkcrbery, south by lands
brught by* one John Cashin, Senior, now deceased.
oor:h by lands belonging to Absolom Rhodes. And
the said petitioners further alleging that the said
John Trowbridge has failed and neglected to pay
said notes and has become insolvent, and that thev
the said petitioners have paid them and that there
is now due them on said notes the sum of eighteen
hundred and forty dollars and fifteen cents, and
praying that the equity of redemption in and to
said mortgaged property may* forever bo foreclosed.
It is ordered that the said John Trowbridge
pay* in to Court on or before the first day of the
next term, the principal and interest due" on said
mortgage, or shew cause why the Equity of Re
demption unto said mortgaged premises should not
be forever barred and foreclosed against him; and
further, that a copy of thE Rule be published in one
of the Gazettes of the City’ - of Augusta, once a
month for four months or served on the said John
Trowbridge or his special agent or attorney, and al
lowing three mouths before the first day of the
next term.
