J TfTPON the petition of John Whitehead, James White he ad and Samuel Dowse, alleging that ■ on the thirtieth day of November eighteen hun dred and forty, John Trowbridge executed to them his certain mortgage deed whereby to indemnify and save harmless said petitioners, conveying two certain notes, made by said Trowbridge to Isaac Bryan, dated on the 28 h day of August, A. D. eighteen hundred and forty-five, each for the sum of eight hundred dollars, the one payable twelve months and the other two years after date,signed by said petitioners as securities, he conveyed to said petitioners certain tracts or parcels of laud lying and being in said county of Richmond, the one being in t lie neighborhood known as Richmond Bath, containing twelve acres more or less, bound ed north by lands of James Whi'ehcad, west by lands of Joshua Key, and south and southeast by the Bath tract. Al-o, two tracts conveyed by said John Trow bridge by Isaac Bryan and described as f Hows, to wit; “All those two tracts or parcels of land situ ate, lying and being in the county of Richmond and State of Georgia, one containing twelve hundred acres, more or less, on Spirit Creek, bounded north by lands of John Gasilin, doc&ased. east by lands of Absolom Rhodes, composed of two tracts, one of one thousand acres, granted to J mes Beall, and another of two hundred acres granted to James McManns. And the said petitioner* further alleging that the said John Trowbridge has failed.and neglected to pay said notes and has become insolvent, and that they the said petitioners have paid them and that th**re is now due them on said notes the sum of eighteen hundred and to: ty dollars and fifteen cents, and praying that the equity of redemption in and to said mortgaged property may forever b° foreclose I.
