ST PON (ho petition of Dennis Carrol, of Murray
5J county, stating that Abner E Holliday dee’d,
of Burke ceunly, t id, in the county of M unrue, on
the 6th day ol October, 1835, by his bond of that
date; a copy oi w hich is filed in this court, bind him
self, bis heirs ami assigns, to execute to one WTI
ham Daniel, and his assigns, ol Murray county, by
the first day of January, 1836, titles to that lot ot
land known by the number one hundred mid
in the 10th district, 13th section, originally Choro-f
kcc county; and stating that said Abner E departed
this life without executing said title; and that thq
said Dennis is the assignee ot said bond; and
praying this court to direct Mathew Jones, the ad
inmistratoi on the estate of said Abner L. to exe
cute title to said lot to the said Dennis. Whereup
on, it is,on motion of Mulford Marsh, counsellor
said Dennis, ordered, that unless good cause i>?
