Quebec, Montreal and Halifax to send two mem bers each to the general assembly, (to be included in the ten returnable by the province) the same privilege to be ex ended to any olh r town as soon as i s population amounts to 15,000 persons. Each of the provinces to have the pri'ilegc of returning two members to represent its i forests in the British parliament. Y, tlx pieat. From the Boston Daily Advertiser. Court of Common Pleas. Satuuiiat, September 8. V’/ie Hamilton Bank vs Put tic Cannon. This was a peculiar and interesting case. The action was brought to recover a sum of money, alleged to have b. cn overpaid to the defendant on a check for If 150 50. Otis Turner, the Teller of the Ham'll on Bank, , testified that the defendant presented a check for | t*'e above mentioned sum on the bth of August last. He was very much engaged at the lime, and casting his eve upon the figures at the top of the check, he thought they were $259 50; he was led into the mistake by a dash which was made before the igurc 1, and near the top of it. He thought it was a pretty large amount tor a person like the defendant to have, but did not road the whole check, by which his mistake would have been corrected, as the amount was written out at length in the body thereof. He asked the defendant what money he would have, and after some conversation respecting U. S. bills, the buler concluded to take Hamilton bills — Witness then took a package ul these bills, (of the denomination of *5.) amounting to $250, and so labelled, and pul in it 9 one dollar bills, ami altered tlie label to $209. He then look out a one dollar bill and put in a Si 50 bill, but left tha label as before. I’e was pn-iltve that the package contained, originally, s‘2so, as he had counted it that morning. He was equally sure that he paid $259 50 on the check. He noticed that the defendant immediately left the bank, taking but a very short time indeed to count the money. At the close of batik hours, he was un able to make his cash balance. There was a / deficiency of just SIOO. He spent some hours with the cashier in looking over his account, but was unable to discover the mistake. On exaim ning Ibis check, the next morning, he immedi ately discovered his error, and went fur the defendant, who denied that there was any mis take and was ve y abmive.
