Huntsville Advocate, (winch if we can lay our
hands on the pa per «vc will publish - , from wh:,:li
it appears that Mr. Smith’s imputations
wore not confined to Chief Justice Manila,l, 1
—•that he likewise assailed the characters of .
(Jen. Smith of Bal.iinore, Mr. Stlobee and
Mr. McDuffie, and questioned the purity <>f
tlieir legislative conduct on liic ground of their
being stockholders of the bank. He is truly
• wholesale maligner—hut it is to be hoped,
that the excoriating letter of Mr. Leigh, alike
withering in its silyre and conclusive in its
vindication of the spotless name whose inte
grity was impugned, will silence the calumni
ous tongue forever.
There is n passage in the latter part of Mr.
Leigh's letter to Dr. Watkins of the 28tlt of
August, which reminds tts of thn following
passage in Churchill’s Epistle to Hogarth;

Chief Justice, who aru apprised of the impu
tation having bean made, and of its having

know the result of my enquiries into the sub

Dear Sir: I should have given yon an ear
lier answer to your latter of tin* Killi inst., but
I was obliged to write to Philadelphia for a
purl of the mloimaluui necessary to enable me
to answer it with certainty and accuracy,
The imputation, which \on inform mo Mr.
Smith ventured to make upon llio late Chief
Justice Marshall, was, that he was the owner
oTTiewnrtten shares of U. S. Dank stock in the
year 1819, when he decided, in the case of
McCulloch against Maryland, that tho chariot
of that Bank was constitutional.
It appeals by Mr. Wheaton s report of the
case, that tho argument of it wascuinnv need
on tho 33.1 February, 1810, and that I he Chief
Justice delivered I liu opinion of the court on
the 7th March.—l When’. 33-'. 400.

31st January, 1819. 1 have obtained copies
•of the two powers of attorney referred to in
(he certificate of the transfer clerk,which also

As it did not appeir from these documents
with absolute certainty, that .Mr. Marshall
had parted with Ins property in the last five
shares, before he decided the case of M’Cnl
inch against Maryland, though I had no doubt
he sold this stock on thn 31st January, the
date of his execution and acknowledgment
of the power of attorney for the Iran-t'er ut It,
—inquiry was made of Mr James H. Lynch ot
this town, whose name appeared ns attesting
witness to the power of attorney, fur exact in
formation ofltm fact. I semi you Mr. Lynch’s
certificate (No. 1 ) in which you wilt find
conclusive proof, that these Five shares wore
sold to him at par, and paid fur, on ihc 3lst
January, 1819, and the power of attorney tor
transferring thiKii was handed to Mr. Lynch
at the saute time, leaving i lie name of the at-
forjMr.Lynch's convenience; and
that Mr. Lynch advised Mr. Marsi all nut to
sell Ills stock, but he assigned as his reason
fur selling, that ho did nut choose to remain a
tUockliulder in the Bank of the U. Stales, na
questions would come before flic supreme
court in which the Bank might be concerned.
It must bo obvious t» those who know Hie
course of such busiurss, that when Mr. Lj -oh
sold these fits shares ofst.ek in Virginia,
fie funded the scrip with the letter of tutor

blue ribbon drawn in full, and firming an exces
sively large rosette, is placed on the summit of the
head ; and long ends from it streams upon the
neck.

Mr. Calhoun had the advan ago yealerday of
making the long, elaborate, argumentative expo
sition of his views on the “absorbing topic,” in
the praaopco of us large and respectable an audi
ence ns ever filled the Senate Chamber. His
doctrines will bo soon placet! before the country.
Col. Be It tun manifos pil a great deal of jealousy
at ilia intrusion of thu Carolinian, into what he
considers his peculiar field. He had no idea of
being deprived of bis thunder; and so, after indu
cing Mr. Calhoun to put off his amendment till
ihe tit rone c mu. should come up, ho came
down with two amendments, which contain the
substance ol his old bill "to re-establish the const!
tmiohal currency of the country," and which he
said would accomplish the object of Mr. Calhoun
iH a different way. So far the two Senatms a
greed; but Benton soon took an opportunity to
recommence the war upon his old antagonist.—
Mr. Calhoun had, in the course of his speech
rofoned casually to the proposed bankrupt law,
and expressed his most deistve opposition to it.
He denounced it as inexpedient, Itar-lt, oj pres,
stvc, and without a shadow of authority in the
constitution.
M*. Benton sneered at this attempt to discred
it the mcasuui in advance—said that it did not

The Senate bill for withholding the October
instalment of the dep sites, was taken up in the
committee ut the whole; hut no progress was
made with it, i . consequence ot the absolute want
ol infill illation in the Home inspecting the slate
of the public finances. No man hero, in or out
of Congress, has been aide to obtain any clear
ideas on this paint from the Secretary’s report. —
The Secretary himself has been convinced of the
fact, fur he has mad a a second attempt to rcnd-.i
himself into ligilde, and sent to the Committee ol
Wavs and Means, what he calls n summary ol
his report, far their convenience. This second
report diHers frrifa the fi st official exposition in
-evcral important particulars, and people arc at a

mend the matter, Mr. Cambrcling read to the
House a statement, which he said ho had prepar

tions were severally commented upon yosterdav
by several members and Mr. Cambrcling’s an

it to be unconstitutional to make the annexation
—but the Chair decided that the resolution was

Mr. Rives of Va. then aro .o and offered the bill '
of which he gave notice, yesterday, to designate j
the funds receivable in payment of the pnblie 1
dues; He entered at leng h upon an exposition
olits provisions and a defence of the position he
had assumed.
He commented in severe terms upon the omis
sion of the Committee of Finance to report such a
measure as that which he now brought forward.
Ho declared ho was opposed lo Ihe President on
the question otcolleciing the R 'venue in Gold &
Shiver. He thought such a plan would he de
liinieiital to the best interests of the country. Not
the least of the mischiefs would he 11 prevent
the tesumpiion of specie payments. He spoke
of the proposition offered by Mr. Calhoun aim
Mr. Benton In regard to iho same oljacl. He
said they corresponded to the policy of the specie
circular policy which has been repudiated and
condcinmed hy the inajv ity of the people. He
staled that the principles of his present proposi- \
lion were generally the same as those of 1 lie Rev.

ments, and that will not lake place for a long
time, unless the Government will manifest 1 pro
per confidence in the currency of the country ; &
