Pursuant to O.C.G.A. § 16-13-49(n),
you are hereby notified that on April
17, 2014, the property described be
low was seized at 100 Perimeter
Trace Dunwoody, DeKalb County,
Georgia by Officer R. Barrett of the
Dunwoody Police Department:
a. Approximately 1.3 ounce of
marijuana; and
b. Approximately 2 grams of cocaine;
and
c. 2004 Cadillac CTS, VIN#
1G6DM577540190019.
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of
marijuana and cocaine.
b. was found in close proximity to
said marijuana and cocaine; or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, on April 15, 2014
Officer R. Barrett, responded to 100
Perimeter Trace #11025 in reference
to a noise complaint that was called
in by the courtesy officer. The cour
tesy officer advised he had received
a complaint from one of the neigh
bors in reference to a loud party at
apartment #11025.
While standing outside of the apart
ment they could hear several people
inside the apartment talking very
loudly. Upon knocking on the door a
male came to the door and asked
"who is it', we responded "Dun
woody Police". The male then walked
off and did not come back to the door
for a short period of time. A male,
later identified as Sinclair Basnight, fi
nally came to the door and we ad
vised that we were there in reference
to a noise complaint. Basnight ad
vised that they were getting ready to
go out to the club and got a little car
ried away. When Basnight opened
the door an overwhelming odor of
burnt marijuana came from the apart
ment. Another male, later identified
as Lij Headly, walked up to the door
next to Basnight. Headly stated they
were just smoking a little weed be
fore going out to the club so they did
not have to smoke in the club.
While talking with Basnight and
Headly there were five other subjects
walking around the apartment. While
talking with Basnight about the
marijuana smell he stated they
already smoked what they had and
they didn't have any more. He then
brought us a small glass cup that had
several small pieces of burnt
marijuana cigarettes and ashes in the
bottom. He stated that was all that
was left. While talking with Basnight
they asked for consent to search his
apartment for any other marijuana he
might have. He stated that he just
wanted to leave and go to the club.
He then kept asking questions about
what would happen and we advised
him that he could give us consent to
search his apartment or we could ob
tain a warrant. The entire time the
front door to Basnight's apartment
was open and the odor of burnt
marijuana did not go away. There
was also an odor of raw marijuana
also coming from inside the apart
ment.
While waiting for him to decide they
had Chatt Comm contact DeKalb
County Dispatch and obtain which
Magistrate Judge was on call. A short
time later they advised that Judge He
advised her of the situation and she
stated that the on call Magistrate
Judge is for violent crimes like
Murder, Armed Robbery or Aggrav
ated Assault and then she hung up
on me. They then advised Basnight
of the situation. The suspected
marijuana was taken and I placed it
into evidence at Dunwoody
Headquarters for testing.
Basnight stated that he is the only
one on the lease. A male, later identi
fied Michael Giralde that was in the
bedroom on the left as you enter the
apartment advised that he stays
there whenever he comes to town.
Giralde and Basnight also advised
that they both have weapons in the
apartment. Basnight advised his is a
pistol and it was in his back pack.
Giralde advised that his pistol was in
the bedroom. Headly also advised
that he does not live there but stays
at the apartment when he comes to
town. The other subjects in the house
advised they were just in town to vis
it. We checked all subjects on GCIC
and Headley had an outstanding war
rant out of Miami for a traffic violation
but they would not extradite him. All
subjects were released at the scene.
On 04/15/14 Officer R. Barrett, re
sponded to Dekalb County Magis
trates Officer and secured a search
warrant for 100 Perimter Trace
#11025, the Heights Apts. The
search warrant was signed by Magis
trate Judge P. Williams, search war
rant number 14-SW-000342.
On 04/16/14 Officer R Barrett served
a search warrant at 100 Perimeter
Trace #11025 the Heights Apart
ments. The other officers there were
Sgt Furman, Sgt Belt, Officer J.
Lewis, Dekalb Sheriff's Deputy Bell
and Sandy Springs K9 Officer M.
DeWald.
At approximately 1930 hrs Officer
Barrett knocked and announced Dun
woody Police, search warrant. He did
this twice with no reply. They then
opened the door with the key
provided by the complex and Officer
Barrett again announced Dunwoody
Police, search warrant, without any
reply. They then cleared the apart
ment to make sure no one was hid
ing. The apartment had a very strong
odor of marijuana coming from it.
Once the apartment was cleared we
then searched the apartment
In the master bedroom officer Barrett
located a Georgia Power bill with the
name Sinclair Basnight on it. It was
located in the small two drawer night
stand next to the bed. In the same
drawer he located a small black box
with the word Micro on the outside.
When looking inside the box he loc
ated a small round plastic container
that contained a greenish brown col
or wax or paste like substance. On
the floor next to the bed we located a
Ruger 9MM pistol with holster. The
pistol was fully loaded. In one of the
dresser drawer we found visa gift
cards.
In the master bathroom Officer Bar
rett located a clear plastic baggy with
suspected marijuana inside. The
clear plastic baggy was sitting on the
counter on top of a magazine. While
searching the master bedroom closet
he located a Florida Driver's License
in a coat pocket with the name of
Jason Tribeca, 02/24/88, with a Flor-
ida License number of
T925252887230. A later check of that
license number showed it not on file.
The license had a picture of Bas
night on it.
While searching the other bedroom
they located a Sig Sauer 9MM pistol,
fully loaded, on the floor partially un
der the bed on the side closest to the
window. On the nightstand next to
the bed a Georgia Driver's license
was found for Michael Giralde. Also
in an ashtray on the night stand Of
ficer Barrett found a partially burnt
hand rolled marijuana cigarette. A fur
ther search of the room he located a
Department of Justice letter address
to Lij Headley in reference to an ap
peal for a gun permit. They also
found a couple of containers that had
marijuana residue in them along with
a small try that also had marijuana
residue on it.
In the living room and kitchen area
they located three cell phones and an
Ipad. They also located a car title for
the Porsche Cayene that Basnight
and Headley were stopped in earlier
by Officer DeWald where he re
covered over $40,000.00 in cash.
The title was given to Officer DeWald.
They also located another title to a
Lexus ES300 that was taken and
placed into evidence. They checked
the parking deck for the vehicle but
did not locate it. In the pantry to the
kitchen they located a food saver va
cuum machine with several food
saver bags in the box. They also
found food saver bags in the house
that contained marijuana residue and
smelled of marijuana. The food saver
bags were the same type that was in
the box. Also on the kitchen table
there was located paperwork where
Giralde had just closed on a home
purchase at 4678 Ash St, Doraville,
Ga. 30338 which showed it was loc
ated in Gwinnett County. The paper
work appeared to show that Giralde
paid for the house in cash. The
vehicle that Giralde owns, 2013 Mer
cedes bearing NY/GKE9922 and
V.I.N. WDDJK7DA2DF018907, was
not at the apartment complex.
While on scene officers had Officer
DeWald and his narcotics certified K9
do a free air sniff around the vehicles
associated with the residents of
apartment #11025. The vehicles in
the parking deck that were associ
ated with the apartment are a white
Cadillac CTS, bearing GA/PRC6965,
and a blue in color older model
Chevy that was under a car cover.
The courtesy officer, Deputy Bell, ad
vised that he has seen on several oc
casions Basnight entering and exit
ing the Cadillac. The older model
Chevy is registered to Headley. Of
ficer DeWald advised that his K9 aler
ted on the Cadillac CTS but did not
alert on the older model Chevy. His
K9 also did not alert on any of the
other vehicles next to these two
vehicles. Brown and Brown wrecker
service was contacted and respon
ded to the scene. The Cadillac was
then impounded and towed to Brown
and Brown Wrecker Service so they
could obtain a search warrant for the
vehicle. Inside on the back seat of
the Cadillac were several pine tree air
fresheners just laying on top of the
back seat.
A copy of the search warrant and the
items taken was left on the kitchen
counter with a list of the items taken.
All items seized were placed into
evidence at Dunwoody Headquar
ters. Upon leaving the apartment it
was secured.
On April 17, 2014 Officer R. Barrett,
responded to DeKalb County Magis
trate's Office and secured a search
warrant for white 2004 Cadillac CTS,
bearing GA/PRC6965, with a V.I.N of
1G6DM577540190019 that was be
ing stored at Brown and Brown
Wrecker Service. The impound lot is
at 3854 N Peachtree Rd, Chamblee,
GA. The search warrant was signed
by Magistrate Judge Dorfman, search
warrant number 14-SW000342.
On April 17, 2014 Officer R Barrett,
executed a search warrant at Brown
and Brown Wrecker Service, 3854 N
Peachtree Rd, on a white in color
2004 Cadillac CTS bearing
GA/PRC6965. He confirmed the
vehicle was the one in the search
warrant. Those present during the
search was Officer D. Laskowski, Of
ficer M. DeWald, Sandy Springs P.D.,
and I.
While searching the backseat area of
the vehicle Officer Laskowski re
moved the backseat and on the floor
under the seat was a clear red in col
or small plastic baggy. Inside the
baggy you could see a white powdery
substance, believed to be Cocaine. A
further search of the vehicle we loc
ated a digital scale under the front
passenger seat.
While searching behind the passen
ger seat Officer Barrett noticed that
the back of the seat was not tight
against the main part of the seat. He
pulled on the plastic cover and it
came out about two inches but was
stopped by what appeared to be a
tiny wire. The back plastic cover to
the driver's seat pulled completely
off. He then reached down into the
opening on the back side of the pas
senger seat and could feel a plastic
bag. The wire was then cut and the
back plastic piece opened up further.
There was a secret compartment in
the back of the passenger seat. I was
able to pull out a plastic food saver
bag which contained another vacu
um seal type bag. Inside that bag
was a large amount of suspected
marijuana. There was also a digital
scale inside the compartment. The
food saver bag was the same type of
food saver bag that we located in the
apartment we executed a search war
rant on.
They then continued to search the
vehicle and noticed that the screws to
the glove box appeared to have been
removed and had marks on them.
They did not appear to be the way
there were when it comes from the
factory. I then removed the screws
from the plastic insert of the glove
box. When taking out the plastic in
sert the area above the glove box did
not appear like it does when it comes
from the factory. Officer Barrett then
had Officer DeWald and Laskowski
look at the area above the glove box.
They advised that the padding in the
glove box appeared to be glued on
and it also had another piece of met
al up in the area that did not appear
to belong there. A wire that was at
tached to a small plastic piece also
fell out. When touching it was a cable
to try to jump the circuit it had power
coming to it from somewhere under
the dash. They advised that the air
bag had also been removed. Officer
DeWald advised that there was what
appeared to be a piston/accuator in
stalled inside the dash. It was con
nected to the air vent on the passen
ger side middle of the dash. We were
able to pop out the vent and it was at
tached to a seat belt buckle and
latch. When removing the vent from
the seat belt buckle and from the
dash it gave you access to the area
behind the dashboard where the air
bag would sit, creating another secret
compartment.
In the vehicle we also located a GPS
that was taken as evidence. We also
located several receipts in the middle
console that had Sinclair Basnights
name on them. We also located 2
U.S.P.S. keys in the middle console.
Officer Barrett left copy of the search
warrant on the front dash. One of the
digital scales was left in the vehicle
when we left. All evidence taken from
the vehicle was placed into evidence
at Dunwoody Police headquarters.
The white powdery substance in the
clear red plastic baggy field tested
positive for cocaine.
Carter was charged with Violation of
the Georgia Controlled Substances
Act. The marijuana and cocaine are
subject to forfeiture pursuant to
O.C.G.A. § 16-13-49(d)(1). The
vehicle is subject to forfeiture pursu
ant to O.C.G.A. § 16-13-49(d)(2),
(d)(3) and (d)(6).
Pursuant to O.C.G.A. § 16-13-
49(n)(3), any claim to the seized
property must be sent within thirty
days to the seizing law enforcement
agency AND to Deputy Chief Assist
ant District Attorney, Kenneth
Hutcherson, by certified mail, return
receipt requested.
