By virtue of the power of sale con
tained in that certain Deed to Secure
Debt (as modified, hereinafter the
“Security Deed”) from Robert
Chandler to Omni National Bank
(with RES-GA FOURTEEN, LLC as
assignee of Multibank 2009-1 RES-
ADC Venture, LLC (“Multibank”), as
assignee of Federal Deposit Insur
ance Corporation (“FDIC”), as receiv
er for Omni National Bank (“ONB”)),
dated December 7, 2006, recorded at
Deed Book 19492, Page 748, DeKalb
County, Georgia records, as modi
fied by that certain Modification
Agreement dated April 5, 2008 and
recorded at Deed Book 21187, Page
413, aforesaid records; said Security
Deed being given to secure indebted
ness under that certain Commercial
Promissory Note (hereinafter the
“Note”) from Robert Chandler to ONB
(with RES-GA FOURTEEN, LLC as
assignee of Multibank, as assignee of
FDIC, as receiver for ONB), dated
December 7, 2006, in the original
principal amount of FIFTY FOUR
THOUSAND ONE HUNDRED SEV
ENTY FIVE AND NO/100 DOLLARS
($54,175.00), with interest on the un
paid balance from the date thereof
until maturity or until paid, together
with all other amounts payable with
respect thereto; there will be sold by
the undersigned at public outcry to
the highest bidder, for cash before
the Courthouse door in Decatur,
DeKalb County, Georgia, within the
legal hours of sale on the first Tues
day in April, 2015, the property being
more fully described as follows:
ALL THAT TRACT OR PARCEL OF
LAND lying and being in Land Lot
172 of the 15th District of DeKalb
County, Georgia, and being known
as Lot 1, Block X of East Lake Ter
race Subdivision, as per plat recor
ded in Plat Book 9, Page 84, DeKalb
County, Georgia records and being
more particularly described as fol
lows:
Beginning at a point at the southeast
corner of Second Avenue and
Swayze Drive and running thence
south along the east side of Second
Avenue 50 feet to the northwest
corner of Lot 2 of said Block and
Subdivision; running thence east
along the north line of said Lot 2,150
feet to Lot 7, said Block and Subdivi
sion; running thence north along the
west line of said Lot 7, 50 feet to the
south side of Swayze Drive, and run
ning thence west along the south
side of Swayze Drive 150 feet to the
east side of Second Avenue and the
point of beginning; being improved
property known as 1816 SECOND
AVENUE, S.E., DECATUR, GEOR
GIA 30032 according to the present
system of numbering houses in
DeKalb County, Georgia.
The debt secured by said Note and
Security Deed has been and is
hereby declared due and payable in
full because of, among other pos
sible events of default, non payment
of principal and interest owed in ac
cordance with the terms of the Note
and the Security Deed. The indebted
ness remaining in default, this sale
will be made for purposes of paying
the same and all expenses of this
sale, including attorney’s fees.
To the best knowledge and belief of
the undersigned, the subject prop
erty is in the possession of Robert
Chandler or parties claiming by,
through or under Robert Chandler.
Said property will be sold as the prop
erty of Robert Chandler on an “as is,
where is” basis, without recourse and
without representation or warranty,
express or implied, of any nature
whatsoever with respect thereto and
will be sold subject to all unpaid
taxes, assessments, and any superi
or items of record, as well as any
matters as would be revealed by an
accurate survey and inspection of the
subject property.
