REGARDING CIVIL PRE-TRIAL
CONFERENCE CALENDARS
This Order shall apply in all civil
cases scheduled on the Court's
++pre-trial conference calendars++.
The Clerk is directed to file and serve
a copy of this Order in each sched
uled case. This Order will be filed one
time in each case and will apply to all
future pre-trial conference calendars.
All parties should read this Order
carefully and comply with its provi
sions.
Not less than seven (7) days prior to
the date of the pre-trial conference,
the parties shall file with the State
Court Clerk a proposed consolidated
pre-trial order in substantially the
format prescribed in Uniform Superi
or Court Rule 7.2. This includes the
proposed order for adopting the con
solidated pre-trial order that is found
at the end of Rule 7.2. All parties
shall participate in preparing the con
solidated pre-trial order, which must
be signed on behalf of each party ap
pearing in the case. If any party fails
to participate in the preparation of a
consolidated pre-trial order, the re
maining parties may prepare and file
their own pre-trial order(s). However,
this is not preferred and could sub
ject a party to sanctions for failure to
participate as directed.
Unless the Court has separately
ordered a different deadline, all dis
positive motions, including, but not
limited to, motions for summary judg
ment, and all motions pursuant to
O.C.G.A. § 24-7-702, including, but
not limited to, Daubert motions, must
be filed no later than seven (7) days
preceding the first date set for a pre
trial conference, regardless of wheth
er the pre-trial conference actually
occurs on the originally scheduled
date. Any issue which may be raised
in a dispositive motion or in a motion
pursuant to O.C.G.A. § 24-7-702 will
not be permitted to be raised through
a motion filed after such deadline.The
filing of a timely dispositive motion or
motion pursuant to O.C.G.A. § 24-7-
702 will automatically remove the
case from the pre-trial conference
calendar, pending the outcome of
them motion, and will excuse all
parties from appearing.
If the parties wish to extend the dis
covery period and/or continue the
pre-trial conference, a consent mo
tion and proposed consent order
must be filed with the State Court
Clerk and transmitted via electronic
mail to Tamika Thompson, Civil Cal
endar Clerk for Division 5, at the be
low e-mail address. The consent mo
tion and consent order also may pro
pose extended deadlines for filing
dispositive motions and motions pur
suant to O.C.G.A. § 24-7-702. The
consent motion and consent order
must bear a signature on behalf of
each party appearing in the case.
Submission of a consent motion and
consent order does not excuse the
parties from appearing at the pre-trial
conference, unless the consent or
der is signed by the Court.
All parties must appear or be repres
ented at the pre-trial conference. Fil
ing a pre-trial order does not pre
clude attendance. Failure to attend
could result in the imposition of sanc
tions. All attorney conflicts will be re
solved as provided in Uniform Superi
or Court Rule 17.1. All attorney
leaves of absence affecting the cal
endar and filed after the calendar is
published will require an application
and Court approval pursuant to Uni
form Superior Court Rule 16.2.
During the pre-trial conference, the
Court will inquire into whether any
discovery remains to be completed,
whether the filing of any further mo
tions is anticipated, and whether
court-ordered mediation could be
helpful in resolving the matter. The
Court strongly prefers to require the
parties to participate in mediation.
The Court's standard mediation or
der provides for two free hours of me
diation through the DeKalb County
Courts Dispute Resolution Center, or
alternatively the parties may elect to
mediate through a private mediator.
When mediation is ordered, it is man
datory that all parties participate such
that an individual with full authority to
settle the case on behalf of each
party is present and participating.
Failure of a plaintiff to participate as
directed in this Order may result in
their complaint being dismissed
without prejudice. This includes coun
terclaim, cross-claim, and third-party
plaintiffs. Failure of a defendant to
participate as directed in this Order
may result in their answer being
stricken and entry of default.

TRIAL CALENDARS
This Order shall apply in all civil
cases that are scheduled on the
Court's non-jury trial calendars. The
Clerk is directed to file and serve a
copy of this Order in each scheduled
case. This Order will be filed one time
in each case and will apply to all fu
ture non-jury trial calendars. All
parties should read this Order care
fully and comply with its provisions.
The ++non-jury trial calendar++ is the
calendar during which the Court con
ducts a bench trial on all issues re
maining in a case. In some cases,
the Court previously denied a motion
for default judgment in whole or in
part. Please carefully read any order
denying a default judgment, because
the Court will require evidence on the
specific issues raised in that order.
Unless the Court has separately
ordered a different deadline, all dis
positive motions, including, but not
limited to, motions for summary judg
ment, must be filed no later than sev
en (7) days prior to the first non-jury
trial calendar date scheduled in a
particular case, whether or not the tri
al actually occurs on the originally
scheduled date. Any issue which may
be raised in a dispositive motion will
not be permitted to be raised through
a motion filed after such
deadline.When a timely dispositive
motion is filed, the case will be auto
matically removed from the non-jury
trial calendar, pending the outcome
of the motion, and all parties will be

CIVIL JURY TRIAL CALENDARS
This Order shall apply in all civil
cases that are scheduled on the
Court's one-week or two-week jury
trial calendars. The Clerk is directed
to file and serve a copy of this Order
in each scheduled case. This Order
will be filed one time in each case
and will apply to all future jury trial
calendars. All parties should read this
Order carefully and comply with its
provisions.
Parties do not have to appear on the
first day of the ++jury trial calendar++
unless otherwise notified by the Civil
Calendar Clerk or other court staff.
Jury trial calendars begin on the date
set forth in the calendar notice that
was served on the parties and contin
ue for all regular business days, ex
cluding legal or court holidays, within
the applicable time period.
The Court typically begins jury trial tri
als on Mondays, Tuesdays, Wednes
days, or Thursdays at 9:30 a.m. or
1:30 p.m. Cases called for a trial be
ginning at 9:30 a.m. will be notified
no later than 5:00 p.m. the preceding
business day. Cases called for a trial
beginning at 1:30 p.m. will be noti
fied no later than 9:30 a.m. the day
the trial will commence.
All motions in limine must be filed
with the State Court Clerk no later
than seven (7) days prior to the first
day of the jury trial calendar. Any mo
tion in limine that is filed or otherwise
raised after this deadline will not be
considered. All proposed jury charges
must be filed no later than the outset
of the trial. A courtesy copy of all mo
tions in limine and proposed jury
charges must be delivered or e-
mailed to Tamika Thompson, Civil
Calendar Clerk for Division 5, at the
time they are filed. All documentary
exhibits that will be used during a tri
al must be marked with a unique ex
hibit number prior to trial.
The Court generally endeavors to call
older cases before newer cases, us
ing the date the complaints were
filed, but this is not always possible
and does not apply to calendars on
which a particular case has been
specially set in the first position. Any
case which is not reached on a given
jury trial calendar automatically will
be continued to the next available
jury trial calendar.
