SEIZURE 4. The Defendant Property in paragraph two was seized by Detective C.V. Greer #2860 of the Dekalb County Police De partment, pursuant to lawful au thority on June 23, 2022, dur ing a search warrant at 3001 Northeast Expy. Apt. 10104, Chamblee, DeKalb County, Georgia. 5. The Dekalb County Police De partment reported the fact of the seizure in writing on July 15, 2022, which is within thirty days of the seizure. 6. The Defendant Property is in the custody or control of the DeKalb County Police Depart ment or the DeKalb County Po lice Department Seizure Ac count with Truist Bank and loc ated in and within DeKalb County, Georgia, and subject to the jurisdiction of this Court. FACTUAL BACKGROUND 7. On June 23, 2022, the man ager of The Arium Apartment complex called the police about a large amount of marijuana seen in plain view by mainten ance. Officer Asquith arrived at 3001 North East Expressway, Atlanta, GA 30341 Apt. 10104, and contacted narcotics Sgt. Oak and Det. R. Viar. Det. Viar, with his K-9 Argo, conducted an open-air sniff at the door of Apt. 10104. K-9 Argo alerted to possible illegal narcotics inside the apartment. A search war rant, 22-SW-000549, was sought and granted for the apartment. DeKalb County Nar cotics and HIDTA executed the search warrant. 8. During the search, the follow ing items were located inside the apartment: Two hundred twenty-four pounds of marijuana were found in the liv ing room, master bedroom, master bedroom closet, hall way, and kitchen, three grams of ecstasy pills were located in a multi-colored can on top of the stove, and a large amount of U.S. currency was found in the master bedroom in an open safe, on the kitchen counter, and in Charleston Kelley's left front pocket. 9. A 2017 white Chevrolet Impala LT, displaying GA. tag TDK7822, registered to Kelley, was located in the front of the building. Det. Tillman conduc ted an open-air sniff of the vehicle with K-9 Cole, who gave a positive indication of il legal narcotics towards the rear of the vehicle. The vehicle was towed by Brown and Brown to South Precinct holding lot. Det. Greer obtained a search war rant, 22-SW-000550, for the vehicle. Det. Tillman executed the search warrant at South Precinct and located one pound of marijuana in the vehicle's trunk, along with miscel laneous packaging material for the marijuana that resembled the same packaging in the apartment. 10. Due to Kelley having a large amount of U. S. Currency in his possession, and the currency and 2017 Chevrolet Impala LT VIN: 2G1105S36H9110571 (est. value $ 19,300.00) being in close proximity to the illegal drugs, it can be inferred that Kelley was using the $51,505.00 in U.S. currency and the 2017 Chevrolet Impala LTVIN: 2G1105S36H9110571 (est. value $ 19,300.00) for the facilitation of illegal drug sales and distribution. 11. Charleston Kelley was arrested and charged with Violation of the Georgia Controlled Sub stances Act, O.C.G.A. § 16-13- 30 and O.C.G.A. § 16-13-31. The U.S. currency was trans ported to Truist Bank, where an employee counted it and de termined it to be $51,505.00 and was then deposited in an account at the bank. 12. The Ecstasy and marijuana were seized pursuant to O.C.G.A § 16-13-49(b)(1). The U.S. currency is subject to for feiture pursuant to O.C.G.A. § 16-13-49(b)(2), (b)(3), and (b)(5); the vehicle is subject to forfeiture pursuant to O.C.G.A. § 16-13-49(b)(6). 13. Said Defendant Property is contraband and should be for feited to the State of Georgia pursuant to the provisions of O.C.G.A. § 16-13-49, in that said property represents pro ceeds derived or realized from a violation of the Georgia Con- trolled Substances Act, O.C.G.A. § 16-13-30. 14. Said Defendant Property is contraband and should be for feited to the State of Georgia pursuant to the provisions of O.C.G.A. § 16-13-49, in that said property was used or in tended for use to facilitate a vi- olation of the Georgia Controlled Substances Act, O.C.G.A. § 16-13-30. 15.
