The debt secured by the Secur
ity Deed is evidenced by a
Commercial Promissory Note
dated September 28, 2016, ex
ecuted by Borrower in favor of
Private Bank of Buckhead in
the original principal amount of
$775,000.00, as further modi
fied by those certain Modifica
tion/Extension Agreements-
Commercial Loan executed by
Borrower dated October 5,
2021 and December 15, 2021,
and as renewed and modified
by that certain Promissory Note
dated June 3, 2022, executed
by Borrower in favor of South-
State Bank in the original prin
cipal amount of $665,159.26
(the Commercial Promissory
Note, inclusive of all modifica
tions thereto, hereinafter col
lectively, the “Note”).
Default has occurred and con
tinues under the terms of the
Note and Security Deed by
reason of, among other pos
sible events of default, the non
payment when due of the in
debtedness evidenced by the
Note and secured by the Se
curity Deed and the failure to
comply with the terms and con
ditions of the Note and Secur
ity Deed. By reason of this de
fault, the Security Deed has
been declared foreclosable ac
cording to its terms.
The Property will be sold to the
highest and best bidder for
cash as the property of Impact
Builders, LLC, the proceeds to
be applied to the payment of
said indebtedness, attorneys'
fees, and the lawful expenses
of said sale, all as provided in
the Note and Security Deed.
The sale shall be subject to the
following: all outstanding ad
valorem taxes and/or assess
ments, if any; possible re
demptive rights of the Internal
Revenue Service, if any; and all
other prior assessments, ease
ments, restrictions, or matters
of record superior to the Secur
ity Deed.
To the best of the
undersigned's knowledge and
belief, the Property is presently
owned by Impact Builders.
LLC.
To the best of the
undersigned's knowledge and
belief, the party in possession
of the Property is Impact Build
ers, LLC, and tenants holding
under it.
