Names and addresses of all known purported owners of the defendant property are as fol lows: Issac Duran, c/o DeKalb County Jail, 4425 Memorial Drive, Decatur, GA 30032; Karla Lopez-Delgado, c/o DeKalb County Jail, 4425 Me morial Drive, Decatur, GA 30032. 4. SEIZURE 5. The Defendant Property in paragraph two was seized by Raul Perez with the City of Brookhaven Police Depart ment, pursuant to lawful author ity, on April 21, 2023, at 302 Perimeter Center N, Apt. 2451, Dunwoody, DeKalb County, Georgia. 6. The City of Brookhaven Police Department reported the fact of the seizure in writing on April 27, 2023, which is within thirty days of the seizure. 7. The Defendant Property is in the custody or control of the City of Brookhaven Police De partment or the City of Brookhaven Police Depart ment Seizure Account with JP Morgan Chase Bank and loc ated in and within DeKalb County, Georgia, and subject to the jurisdiction of this Court. FACTUAL BACKGROUND 8. In September 2022, Homeland Security Investigations (HSI) Atlanta began an investigation of Karla Lopez Delgado. Within six (6) months, HSI Atlanta, in coordination with local law en forcement, conducted four (4) controlled buys of methamphet- amine and/or fentanyl from Lopez Delgado through the use of a confidential informant ("the Cl"). The approximate weight of the fentanyl was 145 grams, and the approximate weight of the methamphetamine was 3.5 kilograms. Using a combina tion of physical and electronic surveillance, law enforcement observed Lopez Delgado deal ing directly from her residence located in Cobb County. On multiple occasions, Lopez Del gado was seen carrying gro cery bags full of bulky items, gift bags, and boxes from her residence to the drug transac tions. 9. On April 7,2023, during surveil lance of Lopez Delgado’s new residence (302 Perimeter Cen ter N, Apt. #2451, Dunwoody, GA 30346, “The Bricks” apart ments), DeKalb County, HSI Task Force Officer (TFO) Raul Perez was able to see Lopez Delgado arriving at the parking deck in a 2013 Gray Range Rover, bearing GA Tag TFZ8701, and unloading a large duffle bag and onto a large laundry basket with wheels. Law Enforcement be lieved the bag was obtained from Lopez Delgado’s source of supply for methamphetam ine based on previous surveil lance. 10. On April 20, 2023, TFO Perez applied for and received DeKalb County Superior Search Warrant number 23-107 to conduct an open-air sniff of Apt. 2451 using a certified drug-detection K-9, and Anticip atory Search Warrant number 23-108 (SW) for a search of the interior of the apartment upon a positive alert from the K-9. At approximately 16:30 hours, TFO Perez met Brookhaven K- 9 Sgt. D. Fikes and his K-9 Bane at The Bricks apartment complex. Sgt. Fikes was in plain clothes and was directed to the front door of Apt. 2451. Sgt. Fikes deployed K9 Bane and received an alert for nar cotics at the front door of Apt. 2451. 11. On April 21, 2023, at approxim ately 06:45 hours, the HSI Nar cotics OCEDFT Strike Force group executed the search war rant at the Bricks apartment complex at 300 Perimeter Cen ter North in Dunwoody, GA, Apt. 2451. Lopez Delgado’s phone ping indicated it was in an approximate area of the apartment. After making sever al announcements at the apart ment’s front door, the door was breached using a ram. Three subjects were found in the apartment, a male, later identi fied as Issac Duran, Karla Lopez Delgado, and her 4- year-old minor daughter. Dur an was called out of the apart ment, and he complied. Duran was handcuffed and detained in the hallway directly outside the apartment. Lopez Delgado did not comply with the officer's commands and stayed in her bedroom with her daughter. Commands were given in both English and Spanish. When the door was breached, the officer could hear the flushing of the toilet and running water. Entry was made to clear the apart ment. Lopez Delgado eventu ally walked out of her bedroom carrying her daughter. She was directed to sit with her daugh ter on the living room couch. When officers initially cleared the apartment, they were able to see a large gallon-sized Zip- lock bag of suspected methamphetamine lying on the floor near the entrance of the apartment. Another gallon sized Ziplock bag of suspected methamphetamine was found inside the toilet bowl where Lopez Delgado had initially been. It appeared that Lopez Delgado was attempting to flush the suspected methamphetamine. Officers seized approximately 4.5 kilos of fentanyl, approximately 19.77 kilos of cocaine, and ap proximately 82.17 kilos of methamphetamine from the apartment and the Mercedes Benz C300. 12. Issac Duran and Karla Lopez Delgado were arrested and charged with Trafficking Fentanyl, Cocaine, and Methamphetamine pursuant to O.C.G.A. §16-13-31. 13. The fentanyl, cocaine, and methamphetamine were seized pursuant to O.C.G.A § 16-13- 49(b)(1). The vehicles are sub ject to forfeiture pursuant to O.C.G.A. § 16-13-49(b)(2), (b)(3) and (b)(5). 14. Said defendant property is con traband and should be for feited to the State of Georgia pursuant to the provisions of O.C.G.A. § 16-13-49, in that said property represents pro ceeds derived or realized from a violation of the Georgia Con- trolled Substances Act, O.C.G.A. §§16-13-30 et. seq. 15. Said defendant property is con traband and should be for feited to the State of Georgia pursuant to the provisions of O.C.G.A. § 16-13-49, in that said property was used or in tended for use to facilitate a vi- olation of the Georgia Controlled Substances Act, O.C.G.A. § 16-13-30. 16.
