FINAL ORDER
On July 25, 2023, petitioner
filed its Complaint-ln-Rem, Lis
Pendens and Hearing Notice.
Consistent with O.C.G.A. § 41-
2-12(a) and these pleadings
were served on the parties, the
complaint was posted on the
property, and a copy of the
Hearing Notice was published
in The Champion Newspaper.
None of the respondents filed
an answer or appeared at the
December 21, 2023, hearing.
FINDINGS OF FACT
The Subject Property is loc
ated in unincorporated DeKalb
County, Georgia at 3269
Woodstock Road, Atlanta,
Georgia 30316, Tax Parcel Id.
No. 15 081 07 001. Since at
least September 21, 2022, the
property has been in a state of
disrepair as follows:
(1) The structure is vacant, un
secure, and unfit for human
habitation.
(2) The property was cited for
various violations including : (a)
the failure to cut and maintain
weeds, grass and the over
growth of vegetation; (b) the
condition of exterior property
areas and unsanitary condi
tions; (c) open storage of trash
and debris; (d) unregistered
vehicles on the property; (e) the
failure to remove inoperable
vehicles; and (f) being an unin
habitable dwelling.
(3) The property is not in com
pliance with applicable codes
and constitutes an endanger-
ment to the public health and
safety as a result of unsanitary
and unsafe conditions.
(4) The property imperils the
health, safety and welfare of
the residents of the neighbor
hood and compromises the
general well-being and quality
of life of the citizens of DeKalb
County.
(5) The County estimates ap
proximately $3,000 is needed
to bring this property into a sat
isfactory state of repair.
RULING OF THE COURT
Based on the evidence presen
ted in this case, the court
FINDS the following:
a. Pursuant to the O.C.G.A. §§
41-2-1, et. seq., and Code of
DeKalb County§§ 18-1, et.
seq., the subject dwelling is un
fit for human habitation, does
not comply with applicable
codes, and imperils the health,
safety and welfare of the cit
izens of the county.
b. Subject to O.C.G.A.§§ 41-2-
1, et. seq., and Code of DeKalb
County§§ 18-1, et. seq., after
thirty (30) days from the date
this Order (“Remedial Period”)
is mailed by certified mail to the
Respondents, the court orders
the respondents, owners and
interested parties, to demolish
the property, cut and maintain
weeds, grass and overgrowth
of vegetation, remove the open
storage of trash and debris,
and remove all vehicles that
are either unregistered or inop
erable. All efforts must comply
with the applicable codes and
regulations. Thirty (30) days
after mailing this Order, the pe
titioner shall re-inspect the
property for compliance.
c. If the Respondents, owners
and interested parties, fail to
bring the property into compli
ance, the court authorizes the
Petitioner to demolish the prop
erty, cut and maintain weeds,
grass and overgrowth of veget
ation, remove trash and debris,
and remove vehicles that are
either unregistered or inoper
able. After the expiration of the
Remedial Period, the
petitioner's abatement actions
shall commence within two
hundred and seventy (270)
days as required by O.C.G.A. §
41-2-9. If these actions are pro
hibited by an injunction issued
pursuant to O.C.G.A. § 41-2-
13, or any equitable relief gran
ted by a court of competent jur
isdiction, then those days shall
not be counted toward the peti
tioner's abatement days.
